Motion de la conseillère McRae

ATTENDU QUE le Conseil municipal d’Ottawa, à sa réunion du 14 septembre 2011, a approuvé une motion demandant au Conseil de santé d’Ottawa de se pencher sur les Règlements sans fumée de la Ville d’Ottawa et de présenter ensuite un rapport comprenant ses recommandations pour les actualiser (voir annexe 1);

ATTENDU QUE la question de la formulation de commentaires sur les bienfaits pour la santé publique de créer davantage d’espaces sans fumée dans la ville est du ressort, de l’intérêt et de l’expertise du Conseil de santé et du personnel de Santé publique Ottawa;

ATTENDU QUE le médecin chef en santé publique a informé le Conseil municipal d’Ottawa que Santé publique Ottawa est en mesure de travailler avec les services municipaux pour mener une étude exhaustive, si le Conseil le souhaite, et formuler des recommandations à cet égard;

PAR CONSÉQUENT, IL EST RÉSOLU QU’on demandera au personnel de mener une étude exhaustive et de formuler des recommandations, de concert avec les Services des règlements municipaux et les Services juridiques de la Ville d’Ottawa, pour actualiser les Règlements sans fumée de la Ville d’Ottawa et que cette étude portera sur la possibilité d’étendre le champ d’application du Règlement sans fumée pour y inclure toutes les plages et tous les parcs publics, tous les biens municipaux, toutes les terrasses ainsi que toute autre recommandation ou possibilité qui protégerait le public contre la fumée secondaire, y compris, mais sans s’y limiter, toutes les demandes du Conseil municipal;

IL EST EN OUTRE RÉSOLU QUE cette étude comprendra un programme de consultation global pour donner suite aux demandes du Conseil municipal;

IL EST EN OUTRE RÉSOLU QU’on demandera au personnel d’inclure la réglementation visant les établissements de narguilés dans le cadre de cette étude, à la demande du Conseil municipal;

IL EST EN OUTRE RÉSOLU QU’un rapport conjoint de Santé publique Ottawa, des Services des règlements municipaux et des Services juridiques de la Ville d’Ottawa faisant état de recommandations pour l’actualisation des Règlements municipaux sans fumée et tenant compte des conditions quant à la faisabilité, aux finances et à l’application sera présenté au Conseil de santé pour recommandation au Comité des services communautaires et de protection et au Conseil municipal.

WHEREAS Ottawa City Council, at its September 14, 2011 meeting, approved a motion requesting that the Ottawa Board of Health review and report back with recommendations on updating Ottawa’s Smoke Free By-laws (see appendix 1); and

WHEREAS the issue of providing comment on the public health value of creating more smoke free public spaces in the City is within the jurisdiction, interest and expertise of the Board and the staff of Ottawa Public Health; and

WHEREAS the Medical Officer of Health has informed Ottawa City Council that Ottawa Public Health is in a position to work with City departments to conduct a comprehensive review, should the Board wish, and provide recommendations on this issue; and

THEREFORE BE IT RESOLVED that staff be directed to conduct a comprehensive study and develop recommendations, in collaboration with the City of Ottawa’s By-law and Regulatory Services and Legal Services, to update the City of Ottawa’s smoke free by-laws and that this study include the investigation of expanding the smoke-free by-law to include all public beaches and parks, all municipal property and all outdoor patios and terraces and any other related recommendations or options that would protect the public from the harms of second hand smoke, incorporating, but not limited to, all of City Council’s requests; and

BE IT FURTHER RESOLVED that this study includes a comprehensive consultation program inclusive of City Council’s requests; and

BE IT FURTHER RESOLVED that staff be directed to include the regulation of water pipe establishments as part of this review, as requested by City Council; and

BE IT FURTHER RESOLVED that a joint Ottawa Public Health and City of Ottawa’s By-law and Regulatory Services and Legal Services report with recommendations on updating the City of Ottawa's smoke-free by-law, including any operational, financial and enforcement considerations be presented to the Board of Health for recommendation to the Community and Protective Services Committee and City Council.
