DIRECTIVES DE RÉDACTION

RÈGLEMENT SUR LES PARCS ET LES INSTALLATIONS

(Règlement no 2004-276, ainsi modifié)

 

 

1)      Ajouter les définitions suivantes à l’article des définitions du règlement :

a)      « propriété municipale extérieure » – La zone extérieure de toute propriété appartenant à la Ville ou louée par celle-ci, y compris sans toutefois s’y limiter un parc, à l’exclusion de :

i)        la propriété louée à une tierce partie;

ii)      la propriété gérée par un conseil local comme le définit la Loi sur les municipalités;

iii)    les établissements de soins de longue durée.

b)       « fumer » ou « usage du tabac » – Tenir un cigare, une cigarette, une pipe allumés ou tout autre appareil servant à fumer du tabac allumé [conforme au Règlement sur les lieux publics]

 

2)      Modifier la définition de « déchets » pour inclure les cigares et les cigarettes.

 

3)      Abroger l’article 12A et le remplacer par une interdiction à toute personne de fumer sur une propriété municipale extérieure.

 

4)      Renseignements généraux

a)      Les modifications au règlement susmentionné comprendront toute révision mineure nécessaire pour leur donner effet.

b)      La date de mise en vigueur des modifications au Règlement sur les parcs et les installations sera le 2 avril 2012.

Drafting Instructions

Parks and Facilities By-law

(By-law No. 2004-276, as amended)

 

 

1)      Add the following definitions to the definitions section of the by-law:

a)      outdoor municipal property” means the outdoor area of all property owned or leased by the City, including but not limited to a park, but does not include:

i)        property leased to a third party

ii)      property managed by a local Board as defined in the Municipal Act

iii)    long term care facilities 

b)       smoke or smoking” includes the carrying of a lighted cigar, cigarette, pipe or other lighted smoking equipment [consistent with the Public Places By-law]

 

2)      Amend the definition of “waste” to include cigars and cigarettes

 

3)      Repeal Section 12A and substitute it with a prohibition on any person from smoking on outdoor municipal property

 

4)      General

c)      Amendments to the above-noted by-law shall include any minor revisions necessary to give effect to the amendments noted

d)     The effective date of amendments to the Parks and Facilities By-law will be April 2, 2012
