Haydon Hall, 110 Laurier Avenue West, Ottawa, on 25 June 2003 at 1:30 p.m. The Mayor, Bob Chiarelli, presided and led Council in prayer. Announcements/Ceremonial Activities KEY TO THE CITY AWARD - MIKE NEMESVARY On behalf of the Council and citizens of Ottawa, Mayor Chiarelli presented the Key to the City Award to Mike Nemesvary, former World Cup freestyle champion skier, who, after a training accident left him a quadriplegic, raised awareness and funds for spinal cord injury rehabilitation and research by completing a seven month "Round the World Challenge" tour. JOSEPH BOULEVARD PLANNING STUDY, OFFICIAL PLAN AND ZONING BY-LAW AMENDMENTS AND URBAN DESIGN GUIDELINES COMMITTEE RECOMMENDATIONS AS AMENDED That Council: 1. Approve the amendment to the former City of Gloucester Official Plan as contained in Document 1. 2. Approve the amendment to the former City of Gloucester Zoning By-law as per the Zoning Details contained in Document 3, for the properties located adjacent to St. Joseph Boulevard as shown in Document 4. 3. Approve the St. Joseph Boulevard Corridor Study as a Community Design Plan which provides a long term vision and guidance for future development on St. Joseph Boulevard, as detailed in Document 5. 4. Approve the streetscaping improvements to occur in 2003 as outlined in this report. 5. Direct staff to prepare a schedule of expenditures for streetscaping improvements to occur over the next five years to be considered for discussion in the 2004 capital budget deliberations as per the St. Joseph Boulevard Corridor Study; And that staff include in the 2004 Capital Budget for the St. Joseph Boulevard Corridor budget options (including cost-sharing) regarding burying overhead wires in this corridor, subject to a local improvement petition or other user-pay mechanism that would see benefiting landowners finance this project; 6. Revise the draft City of Ottawa Official Plan as required to reflect the proposed Official Plan Amendment contained in this report. MOTION NO. 51/5 Moved by Councillor H. DEFERRAL CARRIED MOTION NO. 57/2 Moved by Councillor H. Kreling Seconded by Councillor R. Bloess That the Committee recommendation on the St. Joseph Boulevard Corridor Study be amended as follows: 1. That the Committee recommendation #4 be amended to delete the words "to occur in 2003 as outlined in this report". 2. That the Committee recommendation #5 be amended to replace the word "finance" with "contribute to"; and to add the following phrase, "and that Council and staff give priority to burying over head wires in this corridor at the end of the service life of the pole line or when senior government funding becomes available for such a program, which ever comes first, with the approval of the Council of the day". CARRIED MOTION NO. 57/3 Moved by Councillor R. Bloess Seconded by Councillor H. Kreling WHEREAS at its meeting of March 27, 2003, the Planning and Development Committee recommended to Council to approve recommendation 2 in a Report to Committee for an amendment to the former City of Gloucester Zoning By-law, as per the zoning details in Document 3 and as shown on Document 4; AND WHEREAS changes are required to adjust the extent of the zoning line for three properties as a result of recent development proposals; AND WHEREAS Document 3, number 19 recommends a parking rate of at least 1.0 parking space per 10m2 of gross floor area for stand alone restaurant use; AND WHEREAS Document 3, number 21 limits the required parking for any use to 35% of the lot area which conflicts with the recommended required parking rate for stand alone restaurant use; AND WHEREAS Document 3, number 6 recommends a requirement and this proposed requirement fails to consider those situations where there are three street lot lines and not just two as at a typical intersection of two streets; THEREFORE BE IT RESOLVED THAT the Location Map - Proposed Zoning shown as Document 4 be removed and replaced with the attached Location Map - Proposed Zoning; AND THEREFORE BE IT RESOLVED THAT Document 3, number 21 be amended to read, "The maximum amount of any lot that may be used for required parking for any use permitted in this zone, other than stand alone restaurant use, is 35% of the lot area; AND THEREFORE BE IT RESOLVED THAT Document 3, number 6 be amended to read, "All new buildings must be located between 0.0 and 4.0 metres of a street lot line, except in the case where the lot fronts on three streets, in which case a building or structure must be located no greater than 4.0 metres from only two of the three streets, one of which must be St. Joseph Boulevard, and in the case of a Gateway Site, where a Gateway Site fronts on three streets, a building or structure must be located no greater than 4.0 metres from only the lot lines coincident with St. Joseph Boulevard and the other gateway street; AND THEREFORE BE IT RESOLVED THAT no further notice pursuant to Section 34(16) of the Planning Act, 2001, shall be required. CARRIED Item 2 of Planning and Development Committee Report 47 was then put to Council and CARRIED as amended by Motion Nos. 57/2 and 57/3. Motions of Which Notice Has Been Given Previously MOTION NO. 55/7 Moved by Councillor J. Harder Seconded by Councillor G. Hunter WHEREAS the City of Ottawa had made its support for the Congress Centre expansion conditional on equivalent funding from the Federal and Provincial governments and on a sizeable contribution from the private sectors; AND WHEREAS the Federal and Provincial contributions have now been secured and are on the table; AND WHEREAS these contributions are specifically earmarked for the Congress Centre because its expansion plans are well developed and ready to proceed while transit expansion plans are still in the early stages of development; AND WHEREAS the Federal and Provincial governments have each indicated support and a willingness to work with the City on its transit initiatives; THEREFORE BE IT RESOLVED that the City of Ottawa immediately commit its matching share of funding to the Congress Centre expansion by issuing a debenture in an amount equivalent to the Provincial contribution and that this debenture be funded from the incremental increase in revenues the City will realize from the completed Viking Rideau Project and the Congress Centre expansion; AND BE IT FURTHER RESOLVED that the City of Ottawa continue to work with the federal and provincial government for infrastructure funding for transit. MOTION NO. 55/8 Moved by Councillor R. Bloess Seconded by Councillor D. Eastman WHEREAS negotiations with the Federal Government are on-going for contributions which would include funding for transit priorities as well as for expansion of the Ottawa Congress Centre; AND WHEREAS the negotiations are reported to be positive; THEREFORE BE IT RESOLVED that consideration of this item be deferred until the Council meeting of June 25, 2003 to permit the Mayor to conclude negotiations with the Federal Government and to permit briefing of City Council of the status and progress on this matter. DEFERRAL CARRIED Motion No. 55/7 was replaced with the following Motion: MOTION NO. 57/4 Moved by Councillor G. Hunter Seconded by Councillor J. Harder WHEREAS the City of Ottawa had made its support for the Congress Centre expansion conditional on equivalent funding from the Federal and Provincial governments and on a sizeable contribution from the private sectors; AND WHEREAS those contributions have now been secured and are on the table; AND WHEREAS the Congress Centre expansion plans are well developed and ready to proceed while transit expansion plans are not as well advanced; THEREFORE BE IT RESOLVED that Ottawa City Council re-affirm its commitment from March 27, 2002 and March 26, 2003 to provide a contribution of $25 million for the expansion of the Ottawa Congress Centre, to be paid by a debenture in that amount, that will be re-paid by the incremental tax revenue generated by the expansion of the Ottawa Congress Centre; AND FURTHER BE IT RESOLVED that this contribution be provided to the Ottawa Congress Centre upon the receipt of a building permit for the project by the Ottawa Congress Centre; AND FURTHER BE IT RESOLVED that previous conditions be rescinded but that the City's commitment remain conditional upon Provincial Cabinet confirming its sole ownership of the Ottawa Congress Centre, and confirming that it has full and sole financial responsibility for any cost overruns, budgetary shortfalls and any and all other financial obligations relating to the Ottawa Congress Centre. That Council adopt the Engineer's Report for the Van Gaal Municipal Drain, and give first and second reading to the attached By-law in accordance with Sections 42 and 45 of the Drainage Act of Ontario, subject to adjusting the Webster allowance to a residential assessment. 2. That Council direct staff: a) To work with the area residents south of Perth Street with regard to investigating options for maintenance and cleaning of the ward ditch and sharing of costs, including exploring the role of the Cedarstone Subdivision. b) To work with surface operations roads and parks staff to ensure the effectiveness of the drainage system, including the cleaning of the culvert parallel to and perpendicular to Perth Street adjacent to the Webster property. CARRIED AGRICULTURE AND RURAL AFFAIRS COMMITTEE REPORT 23A DESIGNATION OF DRAINAGE SUPERINTENDENTS - AMENDMENTS TO BY-LAW NO. 2002-293 AND APPOINT OF TILE INSPECTORS COMMITTEE RECOMMENDATIONS That Council: 1. Approve the appointment of persons named in Annex "A" as Drainage Superintendents for the purpose of carrying into effect provisions of the Drainage Act, R.S.O. 1990, and by-laws, regulations and policies of the City of Ottawa, and give first and second reading to the By-law in Annex "B" in accordance with Section 93 of the Drainage Act. 2. Approve the appointment of the persons named in Annex "C" as Tile Inspectors for the purpose of carrying into effect provisions of the Tile Drainage Act, R.S.O. 1990, c. CARRIED CORPORATE SERVICES AND ECONOMIC DEVELOPMENT COMMITTEE REPORT 52 1. SALE OF LAND - 5309 BANK STREET COMMITTEE RECOMMENDATIONS AS AMENDED That Council: 1. Declare a 71.7 ha parcel of vacant land located at 5309 Bank Street, described as Part of Lots 28, and 29, Concession 5 (Rideau Front), geographic Township of Gloucester, City of Ottawa, shown on attached Annex "A", as surplus to the City's needs; 2. Approve the sale of the land referred to in Recommendation 1 to R. W. Tomlinson Limited, for $1,770,000.00, plus GST, subject to any easements that may be required, pursuant to an Agreement of Purchase and Sale that has been received. 3. That the funds from the sale of land at 5309 Bank Street are directed to the Environmental Resources Area Acquisition Reserve Fund for the future purchase of land deemed environmentally sensitive. 4. That Tomlinson will complete a comprehensive Environmental Impact Statement to the satisfaction of the City and the Province, to identify potential environmental impacts to the satisfaction of applicable governmental agencies ("the Environmental Impact Statement"). Tomlinson covenants to address to the satisfaction of the City and the Province all significant environmental features entitled to protection under current applicable laws or regulations and identified in the Environmental Impact Statement. Tomlinson further covenants to develop and incorporate mitigation, compensation and rehabilitation measures into any site development scenarios that are compatible with the contemplated use of the subject property prior to re-zoning approval. 5. That Tomlinson agrees no trees will be removed nor any environmentally sensitive area will be altered prior to the re-zoning approval being finalized. VISUAL IDENTITY ELEMENTS - RULES OF USAGE COMMITTEE RECOMMENDATION AS AMENDED That City Council approve the City of Ottawa Visual Identity Usage Policy, as amended by the following: That in the section Internal Use, sub-section "Ottawa" Wordmark, the first paragraph be amended to add the words "(in normal practise)" to the end of the last sentence. CARRIED 3. INVESTMENT POLICY COMMITTEE RECOMMENDATION That Council adopt the investment policy attached hereto as Annex "A" for the purpose of managing the City's investments. CARRIED 4. APPLICATION TO ONTARIO MUNICIPAL ECONOMIC INFRASTRUCTURE FINANCING AUTHORITY FOR FINANCING COMMITTEE RECOMMENDATIONS That Council authorize the City Treasurer: 1. To proceed with a loan application to Ontario Municipal Economic Infrastructure Financing Authority (OMEIFA) for loans of up to $60,098,000 to provide financing for the projects listed in Annex A; 2. To bring forward a by-law, if required, authorizing the loan application for execution by Council. CARRIED 5. 2004 INSURANCE PROGRAM COMMITTEE RECOMMENDATION That Council approve that the General Manager, Corporate Services, be delegated authority to negotiate terms to renew insurance coverages for the City of Ottawa on the best basis possible, for the period effective January 1, 2004. This represents a pre-commitment against the 2004 budget. CARRIED 6. GEORGINA FALLS MEMORIAL TRUST FUND COMMITTEE RECOMMENDATIONS That Council: 1. Approve a grant to the Manotick Community Association to fund the actual cost of the creation and placement of a mural on the Rideau Township Arena, not to exceed $20,000; subject to the design and mounting of the mural being approved by the People Services Department and the Real Property & Asset Management branch respectively. 2. That an advisory group, as suggested in this report by the Ward Councillor, be established to develop future requests for funding and recommendation to Council on the use of the fund. CARRIED 7. ACQUISITION OF LAND - ABANDONED CP RAIL LINE COMMITTEE RECOMMENDATIONS That Council: 1. Approve the acquisition of the abandoned CP rail rights-of-way known as: a) part of the Prescott Subdivision from Mile 8.12 (being the southerly limit of Leitrim Road) to Mile 25.37 (being the northerly limit of Highway 416) as shown on Annex "A", and; b) part of the Carleton Place Subdivision, now the Carleton Spur, from Mile 7.94 (being the westerly limit of Moodie Drive) to Mile 8.09, as shown on Annex "B", from Canadian Pacific Railway Company and St. Lawrence & Ottawa Railway Company for the sum of $1,376,000 plus GST, subject to an Agreement of Purchase and Sale that has been received; 2. Approve the assumption of License Agreements between Canadian Pacific Railway Company and St. Lawrence & Ottawa Railway Company and certain fibre optical cable companies resulting in revenue to the City of approximately $37,701 per annum, adjusted periodically per the terms of the agreements. PROPERTY ACQUISITION - CANADIAN PACIFIC RAILWAY CORRIDOR BETWEEN INNES ROAD AND INDUSTRIAL AVENUE, BEING PART OF THE NORTH & SOUTH FREIGHT SHED LEADS COMMITTEE RECOMMENDATION That Council approve the acquisition in fee simple of the vacant land owned by Canadian Pacific Railway described as Parts 1, 2, 3, 14, 15 and 16 on Plan 5R-2313, as well as part of Part 4 on Plan 5R-2313, Part 1 on Plan 4R-115383 and part of Lot 32 and 33 on Registered Plan 560, City of Ottawa, and shown as Parcels A, B, C and D on attached Annex "A", for the consideration of $1,906,800.00, plus GST. CARRIED 9. SALE OF SURPLUS LAND - DIDSBURY ROAD COMMITTEE RECOMMENDATIONS That Council: 1. Declare a vacant parcel consisting of 2.378 ha, being part of Didsbury Road, described as Parts 1 through 10 on Plan 5R-14317, save and except Parts 1 and 2 on Plan 4R-13587, as surplus to City requirements; 2. Approve the sale of land estimated to have a market value of $118,000.00, described in Recommendation 1, to Arthur and Mary Van Gaal for $1.00, subject to any easements that may be required. SALE OF PROPERTY - DENIS COOLICAN BUILDING - 495 RICHMOND ROAD COMMITTEE RECOMMENDATION That Council approve the sale of the land and building described as being part of Lot 29, Concession 1, Ottawa Front, known as the Denis Coolican Building at 495 Richmond Road, to Canderel Realties Inc. for the amount of $9,000,000 plus GST, subject to any easements that may be required and pursuant to an Agreement of Purchase and Sale that has been received. REDUCED OPENING HOURS IN CERTAIN INSTITUTIONS AND RETIREMENT HOMES COMMITTEE RECOMMENDATIONS That Council approve: 1. A by-law to make provision for reduced opening hours on voting day in certain institutions and retirement homes in accordance with provisions in the Municipal Elections Act, 1996; and 2. The reduced hours of operation for these facilities be either from 10 a.m. to 2 p.m. or from 4 p.m. to 8 p.m. as shown in Schedule 'A' to the by-law. CARRIED 12. OTTAWA - ARNPRIOR BOUNDARY REVIEW COMMITTEE RECOMMENDATION That Council approve that the current municipal boundary shared with Arnprior remain unchanged. CARRIED 13. CAPITAL FUNDING SUPPORT - THE QUEENSWAY CARLETON HOSPITAL COMMITTEE RECOMMENDATION That Council approve that the Queensway Carleton Hospital be remitted $394,056.28, the amount being equivalent to the fees and charges paid to the City for construction undertaken by the Hospital pursuant to the Hospital's approved 10 Year Capital Program. CARRIED 14. MOTION REGARDING A GRANT FOR THE WESTERN OTTAWA COMMUNITY RESOURCE CENTRE TO OFFSET DEVELOPMENT CHARGES COMMITTEE RECOMMENDATION That Council approve and direct a grant in the amount of $ 25,854 to be paid to the Western Ottawa Community Resource Centre to offset the full amount of development charges that must be paid for this shelter under By-law 140-00 of the former City of Kanata. CARRIED CORPORATE SERVICES AND ECONOMIC DEVELOPMENT COMMITTEE REPORT 52A 1. MARKETS - TRANSFER OF BYWARD MARKET STAND COMMITTEE RECOMMENDATION That Council waive the provisions of Section 19(2) of the Markets By-law Number 191-95 and approve the transfer of the ByWard Market Stand No. 92 and the associated right to be assigned that specific stand from year to year from Wilfred Cleroux to Lucille Cleroux. CARRIED ENVIRONMENTAL SERVICES COMMITTEE REPORT 31 1. CITY OF OTTAWA 2002 DRINKING WATER SYSTEM COMPLIANCE REPORTS COMMITTEE RECOMMENDATIONS That Council: 1. Receive the 2002 Drinking Water Compliance Reports for the following City of Ottawa water systems: the Central Water Supply that includes both the Britannia and Lemieux Island water purification plants, the Vars Water Supply System, the Carp Water Supply System, the Munster Hamlet Water Supply System, the Richmond (Kings Park) Water Supply System, and the Carleton Lodge Water Supply System; and 2. Authorize staff to respond to the Ministry of the Environment, noting that these reports have been considered and received. CARRIED 2. INFRASTRUCTURE MASTER PLAN COMMITTEE RECOMMENDATION That Council approve the Infrastructure Master Plan. CARRIED 3. VILLAGE OF MANOTICK SERVICING MASTER PLAN AND TRUNK SERVICES CONCEPT STUDY COMMITTEE RECOMMENDATIONS AS AMENDED That Council approve the Village of Manotick Servicing Master Plan and Trunk Services Concept Study Report and the following action plan: 1. That Staff will work with the Manotick Master Plan Working Group to address outstanding issues coming out of this study. 2. That the Environmental Services Committee defer recommendations 2 and 3 of Environmental Services Committee report ACS2003-DEV-POL-0031 dated May 22, 2003 until the design guidelines for alternative technologies is complete with assurance that budget funding for design remain in the budget as shown in the 2003 Budget document. CARRIED HEALTH, RECREATION AND SOCIAL SERVICES REPORT 45A 1. INTENSIVE HOG FARMS - REVIEW BY THE MEDICAL OFFICER OF HEALTH COMMITTEE RECOMMENDATIONS That Council approve: 1. the implementation of a 5-year environmental monitoring program to determine impacts, if any, of the farm on surrounding surface water and groundwater, if the proposed hog farm is developed in Sarsfield. 2. the implementation of a 5-year survey of health in the surrounding community, if the proposed hog farm is developed in Sarsfield, and that the survey commence prior to the start of pig production on the farm. 3. the development of scientific expertise, independent of the Office of the Medical Officer of Health, to assess emerging environmental issues as they relate to short and long-term ecological consequences with regard to air, water, soil and non-human species. MOTION NO. 57/8 Moved by Councillor D. Eastman Seconded by Councillor W. Stewart WHEREAS the report by the Medical Officer of Health on Intensive Hog Farms lists three recommendations, the first two of which are derived from Recommendations #1 and #2 of the consultant's report on "Intensive Hog Farms: An Examination of Community Health Issues"; AND WHEREAS the consultant's recommendation #3 which states: "The City have agricultural expertise on its core staff dedicated to agricultural policy and development and the City develop a comprehensive agricultural policy in consultation with the agricultural community to address conflicts between agricultural and rural residential land uses" deals with a concern that has been repeatedly raised and advocated by the agricultural community; THEREFORE BE IT RESOLVED that the consultant's recommendation #3 be added as a fourth recommendation to the Health, Recreation and Social Services report on Intensive Hog Farms, and be approved by Council. CARRIED TRANSPORTATION AND TRANSIT COMMITTEE REPORT 47 1. EMPLOYER PROVIDED TAX-EXEMPT TRANSIT BENEFITS (TEI) COMMITTEE RECOMMENDATIONS AS AMENDED That Council: 1. Renew their commitment to lobby the Federal and Provincial Governments to make employer provided transit benefits income tax exempt. 2. Request that the Federal Government of Canada expand the ECOPASS program from a trial phase to a full scale program available to all Federal public servants in the National Capital Region. 3. Recommend that a delegation from the Transportation and Transit Committee make a presentation to the Federal Finance's Budget Consultation on behalf of the City, to request a tax exempt status for transit; and, that other cities be encouraged to do the same thing. CONSTRUCTION OF ROAD MODIFICATIONS TO RIVERSIDE DRIVE SOUTH OF HUNT CLUB ROAD TO ACCOMMODATE THE PROPOSED RUNWAY CENTRE COMMERCIAL DEVELOPMENT COMMITTEE RECOMMENDATIONS AS AMENDED That Council approve the construction of a median opening, a northbound left-turn lane, a southbound left-turn lane and the future installation of traffic control signals and associated roadway modifications on Riverside Drive 150 m south of Hunt Club Road, to accommodate a proposed commercial development providing that the proponent, 4059930 Canada Incorporated: 1. Enter into a Road Modification Agreement with the City of Ottawa, which will include but not be limited to the following transportation associated conditions: a. All costs associated with the design and construction of the roadway modifications and future traffic control signals and any associated works are to be at the expense of the proponent; b. The proponent will pay the costs to monitor the operation of the median opening and its impact on traffic on Riverside Drive. This monitoring will be done at intervals and of durations to be determined by the General Manager, Transportation, Utilities and Public Works. In the event the General Manager decides that the median opening adversely effects the safe and/or efficient movement of traffic on Riverside, or when the City warrants are met for consideration of the installation of traffic control signals, then the City will require the installation of traffic control signals, at the owner's expense. This shall include the cost of their annual maintenance, in accordance with Council Policy. 2. Execute a legal agreement with respect to the above, and agree to provide financial guarantees acceptable to the City to address these conditions of agreement. 3. That a pedestrian crossing activation button on the appropriate median, form part of the traffic signal design for the Riverside Drive intersection south of Hunt Club Road. CARRIED with Councillor J. Legendre dissenting. 4. INTEGRATED ROADWAY SAFETY PROGRAM COMMITTEE RECOMMENDATIONS AS AMENDED That Council: 1. Approve the establishment of an Integrated Road Safety Program for the City of Ottawa, consistent with Transport Canada's strategic goal and objectives as set out in its Road Safety Vision 2010; 2. Receive for information the City of Ottawa's 2003 Report on Ottawa Road Safety, which provides detailed statistics on the growing number of drivers and vehicles on Ottawa's roadways, and supports the need for an Integrated Road Safety Program; and, 3. Direct staff to report back to Transportation and Transit Committee on the 2004 initiatives of the Integrated Road Safety Program and associated 2004 Budget implications. 4. Direct that the Integrated Road Safety Program produce an annual report to the Transportation and Transit Committee and Council. 5. Direct that the Integrated Roadway Safety Program examine the issue of drivers using cellular phones while operating a motor vehicle and make appropriate recommendations as part of its first annual report. 6. Recommend the addition of Citizens for Safe Cycling (CfSC) to the list of Existing Programs to Improve Road Safety (Annex B). 7. Request that the Provincial government amend the Highway Traffic Act to require pedestrians to identify themselves to police officers as are other users (e.g., drivers, cyclists) of the transportation system. AIR QUALITY CONCERNS COMMITTEE RECOMMENDATION WHEREAS smog is a growing problem in the City of Ottawa; WHEREAS there are several Federal, Provincial, agency and environmental groups involved in initiatives to address air quality concerns; WHEREAS poor air quality in the City of Ottawa costs millions of dollars in lost production through health impacts and lost work days; WHEREAS poor air quality costs millions of dollars in health care costs; WHEREAS poor air quality causes deaths in the City of Ottawa; BE IT THEREFORE RESOLVED That Council recommend that the Medical Officer of Health, in conjunction with the City's Corporate Green Team, prepare a report card for the initiatives of the Federal/Provincial and City governments including a review of the initiatives undertaken since 2000 and a review of their program impacts on air quality in the City of Ottawa; AND that this report be completed and presented to the Transportation and Transit Committee and the Environmental Services Committee by September 30, 2003.
