The Council of the City of Ottawa met at Andrew S. Haydon Hall, 110 Laurier Avenue West, Ottawa, on 23 February 2005 at 12:00 p.m.

 

The Mayor, Bob Chiarelli, presided and led Council in prayer.

 

The National Anthem was performed by the school choir from St. Andrews Catholic School.

PRESENTATION OF FOUR KEY TO THE CITY AWARDS

 

On behalf of the Council and citizens of Ottawa, Mayor Chiarelli presented the Key to the City Award to Shukri D’Jama, Sahra Habbane, Saadia Nuh and Shoon Omar, from the Ottawa Somali community, for their contributions to the community in the areas of education, health, policing and youth.

1.             cREATION OF CITY OF OTTAWA BUSINESS ADVISORY COMMITTEe

 

Committee Recommendations as amended

 

That City Council:

 

1.         Approve the creation of a Business Advisory Committee, with Terms of Reference as contained in Document 1 as amended by the following,

 

WHEREAS THE Business Advisory Committee will be an important vehicle to enhance the City of Ottawa’s lines of communication and relationship with its business community;

 

AND WHEREAS the Business Advisory Committee needs the participation of Ottawa’s agricultural community if it is to effectively represent all Ottawa businesses;

 

AND WHEREAS the draft Terms of Reference names the Ontario Federation of Agriculture (OFA) as one of the seven named organizations to sit on the committee;

 

AND WHEREAS there are a number of other agricultural organizations active in Ottawa’s rural area, in addition to the OFA;

 

THEREFORE BE IT RESOLVED that the agricultural member of the Committee be from any agricultural organization active in rural Ottawa.

 

2.         Select a panel of two (2) Councillors to be appointed to review the applications for membership to the Business Advisory Committee; and

 

3.         Select two (2) Councillors to act as non-voting members of the Business Advisory Committee.

2.             NAME CHANGE FOR SOMERSET HEIGHTS BUSINESS IMPROVEMENT AREA
(By-law 75-89)

 

Committee Recommendations

 

That Council:

 

a)         Approve that the name of the Somerset Heights Business Improvement Area be changed to the Somerset Street Chinatown Business Improvement Area; and

 

b)         Enact a by-law to amend By-Law Number 75-89 of the former City of Ottawa that established the Board of Management of the Somerset Heights BIA to change the name of the BIA to the “Somerset Street Chinatown Business Improvement Area.”

1.             BIOSOLIDS HAULING AND DISPOSAL CONTRACTS - IN CAMERA: 
LITIGATION OR POTENTIAL LITIGATION AFFECTING THE CITY, INCLUDING MATTERS BEFORE ADMINISTRATIVE TRIBUNALS

 

Committee Recommendation

 

That Council approve a five-year contract for the period ending 31 December 2009, in the amount of $15 million with GSI Environment Limited for the hauling and beneficial use of the City’s municipal biosolids.

EMERGENCY AND PROTECTIVE SERVICES COMMITTEE REPORT 10

 

 

1.                   BYLAWS - REPEALS - DRAIN CONTRACTOR AND GARAGE SALES

 

COMMITTEE RECOMMENDATION

 

That Council approve repeal of the by-laws respecting Drain Contractors (former Gloucester) and Garage Sales (former Vanier) as set out in the by-law attached as Document 1.

That Council approve amendments to Licensing By-law No. 2002-189, as detailed in Document 1, to establish harmonized regulations for the licensing and regulation of Rickshaw Owners and Rickshaw Operators.

1.                  That Council request that the Provincial authorities review the adequacy of regulations and penalties currently in place that are intended to protect the health and security of the population and protection of the environment;

 

2.                  That the appropriate Ministers receive this request directly; and

 

3.                  That the City seek the support of the Association of Municipalities of Ontario (A.M.O.) on this file.

PLANNING AND ENVIRONMENT COMMITTEE REPORT 24

 



 

1.             SIGN BY-LAW MINOR VARIANCE - 269 Laurier avenue west

 

 

COMMITTEE RECOMMENDATION AS AMENDED

 

That Council approve a Minor Variance to Signs By-law 36-2000, of the former City of Ottawa, to permit four proposed logo wall signs, one per wall face, on the top floor of each façade with each having an area of 28 square metres, whereas the

by-law only permits an area representing 10 % of the wall area of the top storey of the building, which is in this case is an area of 16.25 square metres.

2.             OFficial Plan Appeal 78 - Richcraft Homes

 

 

COMMITTEE RECOMMENDATIONS

 

That Council:

 

1.         Support the redesignation of a parcel of land owned by Richcraft Homes adjacent to the Carp River and Walter Baker Park, from Major Open Space to General Urban Area;

 

2.        Postpone a decision on the designation of a parcel of land owned by Richcraft Homes adjacent to the Aviation Parkway, pending completion of the Greenspace Master Plan in April;

3.        Communicate this position to the Ontario Municipal Board at a pre-hearing scheduled for February 28, 2005

3.             GREELY COMMUNITY DESIGN PLAN - OFFICIAL PLAN AMENDMENT

 

 

COMMITTEE RECOMMENDATIONS AS AMENDED

 

A.        That Council:

 

1.         Approve the Community Design Plan for the Village of Greely as detailed in Document 6 (separate cover), as amended by the following:

 

a.         Revise all schedules, appendices and associated text within the Greely Community Design Plan to reflect the decision of the Ontario Municipal Board decision of November 1, 2004.

b.         Revise the first sentence of Policy (3)(b) to read:

“A 15-metre setback from the high-water make along both sides of the tributary of Shields Creek, in Concession IV, Lots 6 and 7, must be dedicated to the City as public open space as part of the subdivision approval.”

c.         Remove Policy (5) of Section 7.2 in its entirety.

d.         Revise the last sentence in the “Permitted Uses” description of Section 4.2 to read:

“Given the hydrogeological conditions within Greely, described in Section 3 of this CDP, it is anticipated that lot sizes will be 0.2 hectares (0.5 acres) in size or greater.”

e.                  Revise the second sentence of Section 8.1 to read:

“Many elements on the schedules of this CDP are conceptual, including the specific pattern and location of new collector and local roads; the specific size, configuration, and location of community and neighbourhood parks; and the specific boundaries of land use designations.”

f.                    Revise Policy (3) of Section 6.4 to read:

“Proposed subdivisions that are adjacent to the village boundary consider the local road connections identified on Schedule C during the development review process, and are subject to the requirements of a Traffic Impact Study.”

g.                  Add Policy (8) to Section 4.2 that reads:

“Semi-detached and townhouse dwellings are permitted to be concentrated within part of the lands in Concession IV, Lot 8, based on a connection to the approved, ultimately city-owned and operated, communal water supply and sanitary sewer systems for the Shadow Ridge Estates subdivision, which is described in Section 3.4.  In the event that studies required during the subdivision approval process indicate that such a connection to this system is not workable and/or economically viable, only low density residential uses will be permitted.”

h.                  Remove Policies (2) and (3) of Section 3.3 in their entirety.

i.                    Revise Policy (1) of Section 3.3 to read:

“All development will give consideration to the recommendations of the Shields Creek Subwatershed Study, as they apply.”

 

2.         Adopt Official Plan Amendment No. X to the Official Plan (2003) of the City of Ottawa, as detailed in Document 3, to remove the existing Greely Village Plan and to add the new Greely Community Design Plan.

 

3.         Adopt Official Plan Amendment No. XX to the Official Plan of the former Township of Osgoode, as detailed in Document 3, to remove the policies and schedule as they relate to Village of Greely.

 

4.         Direct Staff to bring forward at a later meeting of the Planning and Environment Committee a zoning by-law amendment, as detailed in Document 4, that implements in part the recommendations of the Greely Community Design Plan.

 

5.         Support a change in the Village of Greely boundary on Schedule A of the Ottawa Official Plan (2003) to include the lands subject to the Ontario Municipal Board Order dated November 1, 2004.

 

6.         Direct staff to communicate this position to the Ontario Municipal Board at its pre-hearing on June 6, 2005

 

B.        WHEREAS road linkages, road connections and walkway connections are developed as part of Traffic-Impact Studies;

 

AND WHEREAS the Greely Community Design Plan indicates a wide variety of possible road linkages and road connections, and walkway connections throughout the Village;

 

AND WHEREAS these indicators may prejudge any future Traffic Impact Study;

 

THEREFORE BE IT RESOLVED that these indicators (arrows) be removed from the Greely Community Design Plan.

 

And that no further notice be provided pursuant to Section 34(17) of the Planning Act.

 


MOTION NO. 29/7

WHEREAS the Greely Community Design Plan, as amended, and associated Amendments to the City of Ottawa Official Plan (2003) and to the Official Plan of the former Township of Osgoode were recommended for approval by the Planning and Environment Committee on February 8, 2005;

 

AND WHEREAS there were typographical errors within the Official Plan Amendments within the report;

 

THEREFORE BE IT RESOLVED that the following changes be made to Section 2.0 of Part B of the Official Plan Amendments:

a)                  Change (5) in the Official Plan Amendment to the Official Plan of the former Township of Osgoode to read “Section 3.12.2.7 is removed in its entirety”;

b)                  Change (8) in the Official Plan Amendment to the Official Plan of the former Township of Osgoode to read “Section 4.2.4 is removed in its entirety”; and

c)         Change (6) in the Official Plan Amendment to the City of Ottawa

            Official Plan (2003) to read “Section 4.2.4 is removed in its entirety”.

5.             ZONING - 2401-2451 St. Joseph Boulevard

 

 

COMMITTEE RECOMMENDATION

 

That Council approve an amendment to the former City of Gloucester Zoning By-Law to change the zoning of 2401-2451 St. Joseph Boulevard from Commercial Mixed Use - Cm to Commercial Mixed Use Exception as shown in Document 1 and detailed in Document 2.

 

DECLARATION OF INTEREST

 

Councillor R. Chiarelli declared a deemed pecuniary interest on Item 5 as his father is a business broker with an interest in a nearby property/business.

 

Councillor R. Chiarelli did not take part in the discussion or vote on this Item.

6.             ZONING - 1985 TRIM ROAD

 

 

COMMITTEE RECOMMENDATION

 

That Council approve an amendment to the former Cumberland Urban Zoning By-Law to change the zoning of 1985 Trim Road from D-R (Development Residential) to CA1-X2 (Commercial Automotive 1 - Exception 2) as shown in Document 1 and detailed in Document 2.

 

CARRIED with Councillor R. Jellett dissenting.

 

 




 

7.             ZONING - 6388 First Line Road

 

 

COMMITTEE RECOMMENDATION

 

That the Council approve an amendment to the former Rideau Zoning By-Law to change the zoning of 6388 First Line Road from General Rural (A2) to General Rural - special zone  (A2 -**) as shown in Document 1 and detailed in Document 2.

8.             ZONING - 88 Bellwood Avenue

 

 

COMMITTEE RECOMMENDATIONS AS AMENDED

 

1.         That Council approve an amendment to the former City of Ottawa Zoning By-Law to change the zoning of 88 Bellwood Avenue from I1 - Minor Institutional to an R3J - Converted House/Townhouse Subzone with exceptions, as shown in Document 1and detailed in Document 3, and;

 

2.                  WHEREAS the City’s intensification policy makes it important to preserve public land and institutional capacity in the developed parts of the City;

 

BE IT RESOLVED that the Province be petitioned to require all school boards make available surplus schools and the associated land to the City for one dollar, as these older schools have all been purchased with property taxes.

And that no further notice be provided pursuant to Section 34(17) of the Planning Act.

That Council defer consideration of the rezoning to the first Council meeting in April 2005 and in the interim direct staff to undertake a preliminary examination of the opportunities for a public private partnership with the proponent building on the original concept proposed in 2002 including a new day care facility, playground facility, community-based activities and residential units;

 

AND BE IT Further RESOLVED that staff report back on the feasibility of exploring such a partnership prior to Council’s decision in April 2005.

9.             ZONING - 205 GREENBANK Road/HYDRO CORRIDOR

 

 

COMMITTEE RECOMMENDATION

 

That Council approve an amendment to the former City of Nepean Zoning By-Law to rezone part of the Hydro Corridor lands north of Bateman Drive to add a parking lot for the church at 205 Greenbank Road as a permitted use; and, to rezone 205 Greenbank Road to permit required parking to be provided off site on the Hydro Corridor lands as shown on Document 1 and as detailed in Document 3.

10.          ZONING - 1460 Merivale Road

 

 

COMMITTEE RECOMMENDATION

 

That Council approve an amendment to the former City of Nepean Zoning By-Law to change the CM - Commercial Major zoning of 1460 Merivale Road to include Automobile Service Station as a permitted use and to include an exemption to permit a reduced parking ratio as detailed in Document 3.

That Council approve an amendment to the former City of Nepean Rural Zoning By-Law to change the requirements of the R1A Block "A" (Residential Special Density - exception) zone for 3100 Bankfield Road as detailed in Document 2.

12.          ZONING - 275 and 425 March Valley Road

That Council approve an amendment to the former City of Kanata Zoning By-Law to change the RI-d Rural Industrial zoning for 275 and 425 March Valley Road to permit a 'golf course' as a temporary use for a period of three years as shown in Document 1 and detailed in Document 3.

13.          ZONING - 75 Scissons road

 

 

COMMITTEE RECOMMENDATION

 

That Council approve an amendment to the former City of Kanata Zoning By-Law 168-94 to add a new zone to the by-law, being the Residential Type 4A zone as detailed in Document 3, and to change the zoning of 75 Scissons Road from "Residential Type 1A-1" and "Open Space-1" to "Residential Type 4A" as shown in Document 1 and as detailed in Document 3.

14.          ZONING - 801 Eagleson Road

 

 

COMMITTEE RECOMMENDATION

 

That Council approve an amendment to the former City of Kanata Zoning By-Law to change the zoning of 801 Eagleson Road from Residential Type 1B - 2 to a new Residential Type 3A - 2 Zone as shown in Document 1 and as detailed in Document 3.

COMMITTEE RECOMMENDATION

 

That Council approve the application for new construction at 688 Manor Avenue, in accordance with the plans filed by Nicholas Caragianis, Architect, received on November 26, 2004.

16.          AMENDMENT OF legal description associated with BY-LAW 169-98 Designating the rideau branch library, 377 rideau street, under part iv of the ontario heritage act

That Council approve the amendment of the legal description of Designation By-law 169-98, designating the Rideau Branch Library under Part IV of the Ontario Heritage Act.

17.          SHIELDS CREEK SUBWATERSHED PLAN

 

 

COMMITTEE RECOMMENDATION AS AMENDED

 

That Council approve, in principle, the Shields Creek Subwatershed Study, Final Report 2, as amended by the following:

 

WHEREAS comments were received regarding the Shields Creek Subwatershed Study following the printing of the final report for the Planning and Environment Committee;

 

AND WHEREAS resolution of these comments is possible through minor amendment to the final report that is in keeping with the intent of the Subwatershed Plan;

 


THEREFORE BE IT RESOLVED that the Guidelines for Site Specific Hydrogeological Studies contained within Appendix O of the Shields Creek Subwatershed Study Final Report and corresponding text (page 5-6) be removed.

THAT the Rules of Procedure be waived to consider and approve the following Motion:

 

WHEREAS the Public Works and Services Department will be bringing forward a report dealing with a review of the City of Ottawa’s existing policy for removing healthy street trees from the public right-of-way based upon receipt of a geo-technical study that links foundation damage and the shrinkage of marine clay to nearby trees;

 

AND WHEREAS this policy review will consider options to tree removals such as mitigation of soil shrinkage by more proactive tree watering and trimming programmes; and a review of current policies regarding litigation and liability issues;

 

AND WHEREAS the Public Works and Services Department will also be reviewing the ‘best-practices’ of urban forestry management in North America;

 

AND WHEREAS the policy review will also be considering factors such as the significance of trees as major streetscaping features, the landmark or heritage status of trees, and the role of trees in providing environmental and urban design benefits;

AND WHEREAS the policy review shall re-examine the most recent scientific evidence underlying the assumptions that trees are the primary contributing factors to clay soil shrinkage, by consulting with urban forest experts such as the Faculty of Forestry, University of Toronto;

 

AND WHEREAS the Public Works and Services Department has agreed to defer the removal of healthy street trees located within the Centretown Heritage Conservation District, pending the policy review which is expected in June 2005

 

THEREFORE be it resolved THAT these removals be deferred until options for tree removals, expected to be contained within the policy review, is considered by the Planning and Environment Committee in June 2005.

WHEREAS the taxpayers of the City of Ottawa are facing a significant property tax increase for 2006, estimated by the City Treasurer to be at approximately 9.1%;

 

AND WHEREAS the Consumer Price Index is the generally recognized measure of inflation, upon which businesses and employers base price and salary increases;

 

THEREFORE BE IT RESOLVED that the budget directions process be directed to consider, first and foremost, any tax increase for the 2006 draft budget limited to the average of the previous twelve months of the Consumer Price Index for the Ottawa region.

WHEREAS the taxpayers of the City of Ottawa are facing a significant property tax increase for 2006, estimated by the City Treasurer to be at approximately 9.1%;

 

AND WHEREAS the taxpayers of the City of Ottawa are facing a significant property tax increase for 2007, estimated by the City Treasurer to be at approximately 7.7%, and further significant property tax increases for 2008 and beyond;

 

AND WHEREAS Pay As You Go contributions are a significant element of the Long Range Financial Plan 2 and the funding of the City’s capital lifecycle needs and future strategic initiatives;

 

AND WHEREAS in 2005, Pay As You Go contributions and capital reserves were reduced to minimize tax increases;

 

AND WHEREAS the City’s first Long-Range Financial Plan noted that former municipalities’ uses of one-time solutions like PAYG contributions and capital reserves to deal with operating budget issues were not sustainable in the long term;

 

THEREFORE, BE IT RESOLVED that in accordance with the Long Range Financial Plan 2, that in future budgets, Pay As You Go contributions be maintained as per Council policy;

 

AND BE IT FURTHER RESOLVED that in accordance with the Long Range Financial Plan 2, that beginning with the 2006 budget, that Pay As You Go contributions will no longer be used to fund operating base budgets (excepting those one-time issues and bridge financing), and that they can only be used for the original purpose for which they are intended.

WHEREAS the City’s Official Plan recognizes “that schools form part of the building blocks of any community, not only in providing education to children, but also amenity space and resource to the neighbourhood”;

 

AND WHEREAS the loss of surplus schools to development means not only the loss of a public building for community use, but also the loss of sportsfields and greenspace;

 

AND WHEREAS the City of Ottawa has on-going policies and associated capital accounts for the purchase of railroad right-of-ways, land in the Marlborough Forest, and environmentally-sensitive lands;

 

THEREFORE BE IT RESOLVED that staff bring forward to Corporate Services and Economic Development Committee a report detailing a policy for Committee and Council to consider for the purchase of surplus school sites.

WHEREAS the current owner at 101 Fourth Avenue has applied for the proper zoning to conduct a small flower store, primarily targeting a pedestrian client, only to discover that the commercial zoning was not in fact in place;

 

AND WHEREAS commercial activities have been conducted at this location (as a non-conforming use) in the past without noticeable impact on the parking on the immediately available spots;

 

AND WHEREAS the request for zoning has indicated that the parking deficit is only one spot;

 

BE IT RESOLVED that this application be granted a cash-in-lieu of parking at a cost of $1.00.
