The Mayor, Bob Chiarelli, presided and led Council in prayer.

1.             ottawa WARD BOUNDARY REVIEW - PUBLIC MEETING

 

Committee Recommendations as amended

 

That Council approve the recommendations contained in the report, Building Consensus - Ottawa Ward Boundary Review dated April 2005, as amended by the following:

 

1.         That the status quo be maintained for Ward 16, in regard to its boundaries with Ward 10.

 

2.         That the current ward boundaries between Beacon Hill – Cyrville (11), Innes (2), Gloucester-Southgate (10) and Alta Vista (18) remain unchanged.

 

3.         WHEREAS the City of Ottawa has recently conducted a review of their ward system that included an extensive public consultation process;

 

            AND WHEREAS the Ward Boundary Review final report was tabled at Corporate Services and Economic Development Committee on 19 April 2005.

 

            AND WHEREAS the residents of Somerset Ward bounded by the Queensway, Bronson Avenue, Carling Avenue and Lebreton Street have communicated their request to be transferred to Capital Ward to their Ward Councillor and to the consultants who prepared the report;

 

            AND WHEREAS the Councillor for Somerset Ward has reviewed this request with the Councillor for Capital Ward, the Preston BIA and the Dalhousie Community Association who are all in agreement;

 

            THEREFORE BE IT RESOLVED that the section of Somerset Ward bounded by the Queensway, Bronson Avenue, Carling Avenue and Lebreton Street be incorporated into Capital Ward.

WHEREAS there is no need to increase the number of wards and size of City Council in order to ensure effective representation that balances the following key factors:

 

·                    representation by population;

·                    geographic size;

·                    maintaining communities of interest, and;

·                    building a strong city;

 

BE IT THEREFORE RESOLVED that the Committee recommendations be amended as follows (see map):

 

1.                  No new wards be created;

2.                  The existing ward boundaries for ward 6 (Goulbourn) remain, as amended by the proposed new boundaries with ward 4 (Kanata) and ward 5 (West Carleton);

3.                  Ward 16 (River) incorporate parts of ward 10 (Gloucester-Southgate) by extending south to include parts of proposed ward 22 east of the Rideau River and west of Bowesville Road;

4.                  The existing boundaries for ward 21 (Rideau) remain, as amended by the proposed new boundary incorporating rural parts of Nepean;

5.                  Future ward boundary reviews explore extending existing urban wards into parts of suburban wards, recognizing common historical links and the fact that the Greenbelt is a shared geographic feature of the community rather than an actual barrier between neighbourhoods;

 

AND that staff bring forward a report on the need for a formula to allocate extra resources to the office of a Councillor whose ward population exceeds by 25 percent or more the city-wide average ward population.

WHEREAS the proposed wards of West Carleton and Kanata North are similar in population;

 

AND WHEREAS the population of the March Rural community (or rural Kanata) was only 2,610 in the last census;

 

AND WHEREAS when the effect of representation by population is minimal the wishes of the community should be the first priority when setting ward boundaries;

 

AND WHEREAS residents of the March Rural community have made it clear that they wish to remain part of a Kanata based ward;

 

THEREFORE BE IT RESOLVED that the March Rural community, consisting of the rural part of the existing Kanata ward, be moved from the proposed West Carleton ward to the proposed Kanata North ward.

THAT the recommendations contained in the report Building Consensus – Ottawa Ward Boundary Review, dated April 2005, be amended further by the following:

 

WHEREAS representation by population is the fundamental building block of democracy;

 

AND WHEREAS in order to respect communities of interest and the exigencies of geography the Supreme Court of Canada has sanctioned variations in determining the size of electoral areas by +/- 25% from the average;

 

AND WHEREAS the recommendations of the Building Consensus – Ottawa Ward Boundary Review do not meet this standard, leaving 10 wards (out of the proposed 23) in Ottawa lying outside of this range in 2006 (falling to 5 wards in 2012);

 

AND WHEREAS modifying the size of the most egregious outlying wards (largest and smallest) will reduce the range of disparity among wards and come closer to meeting the range sanctioned by the Supreme Court, thereby improving the defensibility of these recommendations before the OMB;

 

AND WHEREAS there exists the opportunity to modify slightly the proposed largest ward (Baseline Ward) by adjusting its boundaries to reduce its size from 55,000 to 51,000 in 2006 (from 56,900 to 52,200 in 2012);

 

AND WHEREAS the area bounded by Meadowlands Drive to the north, Merivale Road to the east, the CNR rail line to the south, and Woodroffe Avenue to the west, lies in the former municipality of Nepean, and is currently split in representation between Baseline Ward (Ward 8) and Knoxdale-Merivale Ward (Ward 9);

 

THEREFORE BE IT RESOLVED that the area bounded by Meadowlands Drive to the north, Merivale Road to the east, the CNR rail line to the south, and Woodroffe Avenue to the west, form part of Knoxdale-Merivale Ward.

AND WHEREAS the area bounded by the Carp River to the west, the Queensway to the north, and Castlefrank Road to the east and south (extending westerly at its southern limit to the Carp River) formerly was part of the former Township of Goulbourn, which included Stittsville;

 

THEREFORE BE IT RESOLVED that the area bounded by the Carp River to the west, the Queensway to the north, and Castlefrank Road to the east and south (extending westerly at its southern limit to the Carp River for part of Stittsville Ward (Ward 6).

2.         Request that the Rideau Valley Conservation Authority increase the special municipal levy to the City of Ottawa to fund the Rideau River Flood Control.

That Council:

 

1.         Approve an amendment to the former City of Ottawa Official Plan for the lands as shown in Document 1 and detailed in Document 3.

 

2.         Approve an amendment to the City Council Approved Official Plan for the lands as shown in Document 1 and detailed in Document 4.

 

3.         Approve an amendment to the former City of Ottawa Zoning By-law to change the zoning from Industrial Business Park - IP F(1.0) and Employment Centre - CE[360] SCH. 58 to General Commercial - CG 13 H(12.0)[XXX] for the lands as shown in Document 1 and detailed in Document 5.

WHEREAS the City of Ottawa’s new 2003 Official Plan prohibits big box retail from locating in industrial and business parks;

 

AND WHEREAS Loblaws has applied for an Official Plan and Zoning Amendment to permit a 160,000 square foot store, with approximately 1,000 parking spaces in the Ottawa Business Park;

 

AND WHEREAS the Ottawa Business Park is one of the City of Ottawa’s premier business parks, with prime land situated in close proximity to the Walkley interchange and highway 417;

 

AND WHEREAS the City of Ottawa developed strict guidelines for the use and design of the business park, which did not include big box retail;

 

AND WHEREAS the Ottawa Hawthorne Business Parks Association representing over 600 businesses in the business park has opposed the land use change citing that the Loblaws proposal is incompatible with existing zoning and the City of Ottawa’s Official Plan; and the main purpose of the park was to be a higher-end alternative for light industry and for offices to serve the region;

 

AND WHEREAS Staff advised that commercial services uses, including fast food restaurants and a gas bar have been permitted in the Ottawa Business Park, therefore opening the door to retail use;

 

AND WHEREAS this use was permitted by the former City of Ottawa to provide services to the business park and this zoning change would be permitted under the new Official Plan;

 

AND WHEREAS the Loblaws OPA and Zoning applications were scheduled for the May 10, 2005 Planning and Environment Committee, prior to Committee and Council’s debate on the appropriate location for big box retail in the report under the title of Official Plan Amendment- Comprehensive City-Wide Amendment in Response to Retail-Related Appeals to the 2003 Official Plan (File D01-01-04-0033);

 

AND WHEREAS THE Planning and Environment Committee’s recommendation to Council is that big box retail not be permitted in business parks;

 

THEREFORE BE IT RESOLVED that Ottawa City Council reject the amendment to the former City of Ottawa Official Plan for the lands as shown in Document 1 and detailed in Document 3;

 

AND Council reject an amendment to the City Council Approved Official Plan for the lands shown in Document 1 and detailed in Document 4;

 

AND Council reject an amendment to the former City of Ottawa Zoning By-law to change the zoning from Industrial Business Park- IP F(1.0) and Employment Centre-CE (360)SCH.58 to General Commercial- CG 13H (12.0) (XXX) for the lands as shown in Document 1 and detailed in Document 5 in the report.

PLANNING AND ENVIRONMENT COMMITTEE REPORT 30A

 



 

1.             SIGN BY-LAW MINOR VARIANCE - 780 Baseline Road

 

 

Committee RECOMMENDATION AS AMENDED

 

That Council refuse a Minor Variance to Signs By-law 36-2000, of the former City of Ottawa, to allow a proposed wall sign to exceed the uniform height, area and arrangement of other signage on the same building coverage contrary to the design provisions of the by-law, subject to the following amendment:

 

That Council approve a minor variance to permit the sign to extend in part outside of the existing sign band as detailed on the attached elevation.

2.                  That the Trail Road Household Hazardous Waste permanent depot be closed to achieve cost savings of approximately $208,000 annually as a component of the Corporate Efficiency Targets for 2005.

4.             OFFICIAL PLAN AND ZONING - 138 SOMERSET sTREET wEST and text change to centretown secondary plan

 

 

Committee RECOMMENDATIONS AS AMENDED

 

That Council:

 

1.         Request the Ontario Municipal Board to modify:

 

i)          Official Plan Amendment No. 62 being an amendment to Schedule H of Volume 1 of the Official Plan of the former City of Ottawa; and,

 

ii)         Official Plan Amendent No. 20 being an amendment to the Council Adopted (2003) Official Plan;

 

for the east part of 138 Somerset Street to remove the area from the land use schedules, as shown in Document 2 and detailed in Document 3.

 

2.         Approve and adopt amendments to the Centretown Plan included as Chapter 3.0 in Volume 2 to the former City of Ottawa Officical Plan and included in Volume 2A of the City Council Adopted (2003) Official Plan as follows and as detailed in Document 3:

 

i)          For the east part of 138 Somerset Street to amend the land use schedule from a “District Commercial Area” designation to a “Residential Area – Medium Profile” designation.

 

ii)         Add new text to permit consideration through a Zoning By-law Amendment of development proposals with a height over nine-storeys within areas designated ‘Residential Area – Medium Profile’ under limited conditions.

 

3.         Approve an amendment to the former City of Ottawa Zoning By-Law as shown in Documents 1 and 2 and detailed in Document 5, subject to the amendment outlined in iii) noted below, to:

 

i)          change the zoning of the east part of 138 Somerset Street West from CN12 and CN6 F(3.0) H(18.3) - Neighbourhood Linear Commercial Zones to a new R6C - High-rise Apartment Zone with exceptions to modify performance standards and to permit parking garage as a permitted use; and,

 

ii)         amend the CN12  - Neighbourhood Linear Commercial Zone as it applies to the west part of 138 Somerset Street West to permit required parking to be provided off site and to reduce the minimum rear yard setback required from 7.5 metres to 1 metre.

 

iii)                include a modification to Document No. 5 - Details of the Recommended Zoning by adding a new subsection 2.2.4 under Section 2 to read as follows:

 

2.2.4 - A rear yard of 0.0 metres for a parking garage only and the maximum permitted height above grade for a parking garage only shall not exceed 1.0 metre.

 

4.         At such time as the Owner/Developer (Teron Inc.) enters into a Municipal Housing Facilities Agreement to allow for and secure the deferral of Development Charges and where the Owner/Developer defers a portion of its selling price equal to the amount of the development charges to be deferred to provide assisted ownership units below market affordability within a 100 % affordable housing project at 138 Somerset Street West, Planning and Environment Committee recommends that Council:

 


i)          defer planning application fees, building permit fees and cash-in-lieu of parkland fees in accordance with the affordability proposal detailed in Document 8; and,

 

ii)         endorse Document 8 as the framework for the agreement to be entered into by the Owner/Developer (Teron Inc.).

 

And that no further notice be provided pursuant to Section 34(17) of the Planning Act.

 

MOTION NO. 35/9

WHEREAS the Planning and Environment Committee at its meeting of May 24, 2005 considered, at a public meeting, and recommended approval of a staff report (Report Ref. No. ACS2005-PGM-APR-0129) dealing with Official Plan and zoning amendments for the property at 138 Somerset Street West to accommodate a proposed affordable housing development;

 

AND WHEREAS the details of the recommended zoning as set out in Document 5 of the staff report provided for part of the property situated within the east portion of 138 Somerset Street West be used for parking by St John’s Church located within the west portion of the property;

 

AND WHEREAS the recommended zoning intended that the parking to be owned by St John’s Church could be used also for other uses and that St John’s Church, being in a Heritage District, did not require parking;

 

AND WHEREAS the details of the recommended zoning omitted to specify these matters with respect to the parking to be owned by St John’s Church;

 

THEREFORE BE IT RESOLVED that Document 5, Details of Recommended Zoning included in Report Ref. No. ACS2005-PGM-APR-0129 be modified to include a new Subsection 1.3 under Section 1 to read as follows:

 

1.3       No parking is required for the place of worship located at 138 Somerset Street West.

 

AND BE IT FURTHER RESOLVED that no further notice be provided pursuant to Section 34(17) of the Planning Act RSO 1990.

 

All other details remain unchanged.

That Council approve an amendment to change the zoning of 6400 Flewellyn Road from Rural (RU) to Rural Exception (RU-x) and to change the zoning of 6366 Flewellyn Road from Rural (RU) to Rural Commercial Exception (CR-x), as shown in Document 1 and detailed in Document 3, as amended by the following:

 

That “Document 3” DETAILS OF RECOMMENDED ZONING be amended by deleting the following statement in its entirety:

 

“Rural Commercial Exception Zone (CR-x)

 

Notwithstanding any provisions of this By-law to the contrary, the lands zoned CR-x on Schedule “A” hereto shall only be used in accordance with the following:

 

i)                    Uses Permitted:

Office, Business

Public Storage”

 

The above statement shall be replaced with:

That Council approve an amendment to the former Township of Goulbourn Zoning By-Law to change the zoning of 7259 Highway 7 from Open Space Zone (OS) to Open Space Exception Zone, (OS-x), and that a holding (h) symbol be added to the OS-x zone, to permit a flea market as shown in Document 1 and as detailed in Document 3, as amended by the following:

 

a.                  That Document 2 of the report, Explanatory Note, be amended as follows:

 

Last sentence: The Holding Zone denotes that the land cannot be used for a flea market until such time as the holding symbol is removed. The holding symbol can only be removed after approval is received from the proper authority for access to Highway 7 for the flea market.

 

2.                  That Document 3 of the report, Details of Proposed Zoning, be amended as follows:

 

1          (c)        When a holding symbol (h) is present on lands zoned OS-x:

 

(i)         the land cannot be used for a flea market until such time as the holding symbol is removed;

(ii)        the holding symbol can only be removed after approval is received from the proper authority for access to Highway 7 for the flea market.

 


And that no further notice be provided pursuant to Section 34. (17) of the Planning Act.

That Council:

 

1.                  Support the re-designation of a parcel of land (Site 1) owned by Richcraft Homes adjacent to the Aviation Parkway, from Major Open Space to General Urban Area, amended by the following:

 

That the City explore with Richcraft the possibility of protecting all or part of this greenspace.

 

2.         i)          Retain the City’s Official Plan designation Major Open Space for each of the four parcels listed below and that this position be defended at the upcoming OMB hearings:

 

a.         Parcel of land (Site 2A) owned by the National Capital Commission located adjacent to 495 Richmond Road, from Major Open Space to General Urban Area;

b.         Parcel of land (Site 2B) owned by the National Capital Commission located between Woodroffe and Merivale Roads, from Major Open Space to General Urban Area;

 

c.         Parcel of land (Site 2C) owned by the National Capital Commission located adjacent to McCarthy Woods and fronting Riverside Drive, from Major Open Space to General Urban Area;

 

d.         Parcel of land (Site 2D) owned by the National Capital Commission and lying between McCarthy Road and the Airport Parkway, from Major Open Space to General Urban Area;

 

ii)         Agree that, for any of the parcels, amendment to the Major Open Space designation be considered only at such time as the NCC has a specific alternate use to propose for the parcel.

 

3.         Support the modification of the policies of the Official Plan in regards to the acquisition of land in the Natural Environment Area, Urban Natural Features and the Major Open Space designations, as shown in Document 1 of this report;

 

4.         Communicate this position to the Ontario Municipal Board at its next available pre-hearing of the Official Plan appeals.

4.         Approve the pre-commitment of $4M in the 2006 budget for the Carling LRT EA and the Rideau/Montreal LRT EA studies.

1.                  Permanent access to the residential development known as Place des Gouverneurs Subdivision, at the location on Cyrville Road previously approved by Council on 22 October 2003 as an interim access, subject to the proponent, Richcraft Ltd., funding all costs associated with:

 

a)                  The design and construction of the roadway modifications as detailed in the report and as shown on Annex "C" of this report;

 

b)                  The installation of traffic control signals at the intersection of the site access with Cyrville Road including the operating and maintenance costs for the traffic control signals until such time as the warrants are met for their installation; and,

 

2.                  Execution of a legal agreement with respect to the above, including agreement to provide financial guarantees acceptable to the City to address all costs associated with the revised design and construction of the roadway modifications and traffic control signals.
