The Mayor, Bob Chiarelli, presided and led Council in

Activities
MOMENT OF SILENCE
A moment of Silence was observed in memory of Firefighter Mark Johnston who lost his battle with
cancer on 7 April 2006. Mr. Johnston
battled for compensation for himself and other colleagues stricken from
exposure to toxic chemicals on the job.

the City of Ottawa is committed to working with all of its residents and
stakeholders for the betterment of the community;
AND WHEREAS
the rural and farming communities are an integral part of the City of Ottawa;
AND WHEREAS
the City of Ottawa, through the Rural Summit, committed itself to assisting the
rural and farming communities addressing their particular needs;
AND WHEREAS the
Ottawa Farmers’ Market Association want “to establish and maintain a Farmer’s
Market for the purpose of marketing premium quality Ottawa region farm produce
produced only by the vendor and to improve production of, stimulate public
interest in, and increase consumption of these products”;
AND WHEREAS the City
of Ottawa is dedicated to the preservation and continued enhancement of its
historic ByWard and Parkdale Markets that have operated for 180 and 83 years
respectively;
AND WHEREAS the City
of Ottawa, the ByWard and Parkdale Market vendors, and the ByWard Market
Standholders Association are committed to ensuring that the ByWard and Parkdale
Markets offer a wide variety of fresh farm-products and quality art and craft
from vendors residing primarily in Ottawa/Gatineau;
AND WHEREAS the City
of Ottawa had its authority to differentiate between producers and resellers of
fruit and vegetables and art and craft at its ByWard and Parkdale Markets
limited by a Court decision in 1995;
THEREFORE BE
IT RESOLVED that the Agriculture and Rural Affairs Committee recommend that
Council approve the Ottawa Farmers’ Market Association’s Farmer’s Market pilot
project;
AND BE
IT FURTHER RESOLVED that, subject to availability, this project be located at
Lansdowne Park for the first two years of operation, in 2006 and 2007;

other products based on the point of origin, time of year, percentage actively
and directly produced by the vendor; and, to establish a contract system to
provide for different conditions, criteria for assignment, fees and terms for
each class or classes of activity;
AND BE IT
FURTHER RESOLVED that staff continue to work with the ByWard Market
Standholders Association and Parkdale Market vendors to develop policies and
regulations, with the input of all Market stakeholders, that will ensure the
long-term success of the ByWard and Parkdale Markets as venues for fresh local
fruits and vegetables, local art and craft and other local products.

Approve an amendment to Development Charges By-law 2004-303 to
reflect changes in the area-specific stormwater rates for Leitrim resulting
from changes to the Area Specific Development Charges Background Study dated
June 28, 2005.

Approve the revised Leitrim area-specific development charge growth
projections and rates listed in Document 3.
3.
Authorize the City enter into a Front-Ending Agreement with Tartan
Land Corporation for land acquisition, design, and construction for the Leitrim
Community Pond 1, based upon the principles set forth in Document 1, and
Council approved Front-Ending Policy noted in Document 2 with the final form
and content of the Front-Ending Agreement being to the satisfaction of the
Deputy City Manager, Planning and Growth Management Department and the City
Solicitor.
4.
Approve the revised expenditure of $11,613,000 for land acquisition,
design, and construction of the Leitrim Pond 1 subject to the execution of the
Front-Ending Agreement.
5.
Authorize the City to enter into subdivision agreements, which
provide for the repayment of storm sewer over-sizing estimated at $6,572,444 in
accordance with the principles set forth in Document 2.
6.
Authorize the City to establish a revised budget in the amount
$18,185,444 for related Pond 1 land acquisition, design, construction, and
Trunk Storm Sewer over-sizing works under Internal Order Number 903226: SWM
Pond 1 Leitrim and Storm Sewer Oversizing.

10. RURAL SUMMIT - GRANT
PROGRAM TO OFFSET BUILDING PERMIT FEES FOR FARM BUILDINGS |
That Council:
1.
Approve the establishment of a
grant program for offsetting the building permit fees associated with the costs
of construction and/or renovation of farm buildings/structures, regulated under
the Nutrient Management Act, used for the collection, storing and
handling of manure containing nutrients, and a process by which fees are offset
at the time of the submission of the application for the building permit.
2.
Approve the reimbursement of
$3250.80 in building permit fees collected between July 1, 2005 and March 14,
2006, as set out in Schedule A to this
report, for farm buildings/structures, regulated under the Nutrient
Management Act, used for the collection, storing and handling of manure
containing nutrients.

11. CAPITAL FUNDING SUPPORT -

That Council approve that
the Ottawa Hospital be remitted $150,145.76, the amount being equivalent to the
permit fees paid in 2005 to the City for construction projects
undertaken by the
Ottawa Hospital at the General, Riverside and Civic Campuses pursuant to the
hospital’s approved 10 Year Capital Program as noted in Schedule A to this
report.

12. FEE RELIEF FOR CONSTRUCTION/RENOVATION
OF CHARITABLE and NON-PROFIT AFFORDABLE HOUSING |
That Council approve the
reimbursement of $47,284.00 in building permit fees collected between July 1,
2005 and March 17, 2006, as set out in Document 1 to this report, and the
provision of additional grants in lieu of building permit fees in an amount up
to $52,716 for qualifying construction projects in 2006 that are not funded
through Action Ottawa.

13. DEFERRAL OF DEVELOPMENT
CHARGES FOR HABITAT FOR HUMANITY |
That Council approve one
time funding of $19,306 from the Development Charge Reserve Fund to offset
development charges Habitat paid last year on their development at 859-861
Pinecrest and delegate authority to the
Director of Housing to enter into Municipal Housing Project Facilities
Agreement with Habitat for Humanity to allow for and secure the deferral of
Development Charges in the amount totalling $38,612 for the development charges
associated with the four Habitat homes at 859-861 Pinecrest and 855-857
Pinecrest.

14. CANADIAN TULIP FESTIVAL REQUEST FOR EMERGENCY
FUNDING |
That Council:
1.
Approve a one-time
emergency grant in the amount of $75,000 for the Canadian Tulip Festival,
allocated from the City-wide Capital Reserve Fund, to help finance programming
and immediate cashflow requirements for 2006;
2.
Forgive the
existing arrears, in the amount of $32,613, owed to the City by the Canadian
Tulip Festival for OC Transpo shuttle bus service in 2005;
3.
Direct OC
Transpo to cover the net cost, expected to be approximately $23,000, for the
2006 Canadian Tulip Festival weekend shuttle bus service;
4.
Direct OC
Transpo and the Canadian Tulip Festival to jointly develop a long-term
partnership agreement and report back to Council by December 2006;
5.
Direct the
Canadian Tulip Festival to develop and provide to the City of Ottawa a
long-term financial sustainability plan by December 2006 for staff review and

program administration costs for the Green Partnership Pilot Program be funded
from within the approved capital funding allocation.
8. That the Green Partnership Pilot Program, along with
associated Cleaning the City and Greening the City Actions of Fall Cleaning the
Capital and the Litterbug campaign be officially launched during the 2006
Spring Cleaning the Capital Launch.

WHEREAS the taxpayers of the City of Ottawa are
facing a significant property tax increase for 2007, estimated by the City
Treasurer to be at approximately 8.1%;
AND WHEREAS the taxpayers of the City of Ottawa
are facing further significant property tax increase for 2008 beyond;
AND WHEREAS
the City of Ottawa has traditionally approached the creation of its budgets
from the expenditure side as apposed to the revenue side of the ledger;
AND WHEREAS
the taxpayers of the City of Ottawa can not afford significant tax increases;
THEREFORE, BE IT RESOLVED that, beginning with
the 2007 budget, Council directs staff to create the City of Ottawa’s budgets
using a revenue approach. Revenue
estimates are based on the previous year’s municipal
tax rate, and may increase to a maximum of the average consumer price index, of
the Ottawa region, of the last twelve months from the date of adoption of the
budget.

THEREFORE, BE IT RESOLVED that City staff are
directed to bring in a tax increase for the 2007 budget that is limited to the

adoption of the budget, of the Consumer Price Index for the Ottawa region.

Franco-Ontarian festival has existed for over 30 years;
AND WHEREAS
the Franco-Ontarian festival constitutes and important venue for the Ottawa
community, most notably its francophone community;
AND WHEREAS
the City has financially supported the Franco-Ontarian festival since its
inception;
AND
WHEREAS the company conducting the festival’s activities declared bankruptcy in
2005 with an impending loss to the festival of $380,000 and caused it to
declare bankruptcy as a result of the firm’s loss;
AND WHEREAS
as a result of that bankruptcy, the newly formed Franco-Ontarian festival could
not meet the City’s eligibility criteria for festival funding;
AND WHEREAS
the community wishes to maintain the momentum towards the rebirth of the
festival
AND WHEREAS
the City wants to ensure the survival of the event;
BE IT RESOLVED
that the City provide one-time emergency-funding in the amount of 50, 000$ to
the festival from the City wide Reserve Fund for operation of the
Franco-Ontarian festival in 2006

WHEREAS the
Madonna della Risurrezione Parish is hosting its 21st Annual Community Festival on Friday, May 26th and
Saturday, May 27th, 2006 between the hours of 6:00 p.m. and 1:00
a.m. and on Sunday, May 28th, 2006, between 8:30 a.m. and 11:00
p.m.;
AND
WHEREAS exemption from subsections 18(1) and 19(3) of the City of Ottawa Noise
By-law (2004-253) is required to allow the use of sound reproduction devices
which may surpass the allowed 55 decibel level, but will not exceed 65
decibels, in effect until 11:00 p.m. or which may disturb the peace and comfort
of a resident after 11:00 p.m.;
THEREFORE BE IT RESOLVED that the provisions of subsection 18(1) and 19(3) of the City of Ottawa Noise By-law (2004-253) shall not apply so as to preclude the use of sound reproduction devices during the Madonna della Risurrezione 21st Annual Community Festival, which may exceed 55 dBA, but will not exceed 65 dBA, when measured at the property line of a business person or person whose peace and comfort is disturbed before 11 p.m. or disturbs the peace and comfort of a resident whose peace and comfort is disturbed after 11:00 p.m. on the dates of May 26th, 27th and 28th, 2006.

represented the City of Ottawa on the Board of Directors for the Rural Ontario
Municipal Association (“ROMA”) for the last five years;
AND WHEREAS Councillor Thompson was
recently appointed Chair of ROMA at its joint conference with the Ontario Good
Roads Association (“OGRA”) in February 2006;
AND WHEREAS the position of ROMA Chair
will require Councillor Thompson to be in Toronto on the second Tuesday of each
month to chair board meetings;
AND WHEREAS these board meetings occur on
the exact same date as meetings of the City’s Emergency and Protective Services
Committee;
AND WHEREAS Councillor Thompson has
decided to resign from the Emergency and Protective Services Committee in order
to meet his ROMA commitments, but has expressed a willingness to remain as
Vice-Chair of the License Committee;
THEREFORE BE IT RESOLVED that Council
accept Councillor Thompson’s resignation but approve his continuation as
Vice-Chair of the License Committee.

City of Ottawa has negotiated a Memorandum of Understanding for the use of the
Bowesville site from the Ottawa Airport Authority;
AND WHEREAS
the City has a sports field deficit of 200 fields;
AND WHEREAS
the City is reviewing multiple sites for its rail maintenance yard;
AND WHEREAS
the City has completed a study identifying potential sportsfield sites (June,
2005) identifying the Bowesville lands as entirely suitable for sportsfields;
AND WHEREAS
the City received informally, conflicting data on lands at or near the Ottawa
Airport in the context of aviation safety, bird hazards and crash zones;
AND WHEREAS
the City has seen no study or report prepared by any authoritative bird hazard
specialist in the context of (a) aviation safety, (b) bird hazards, (c) crash
zones, (d) use of the Bowesville lands for a 30 soccer field facility or any
other purposes, and (e) the Ottawa Airport;
THEREFORE BE
IT RESOLVED that the City undertake negotiations with the Ottawa Airport
Authority for the potential use of the Bowesville site for use as multipurpose
sports and recreation facilities, run by either the City or a Public-Private Partnership
or other entity;
AND FURTHER
that the City conduct a economic assessment of the financial impact of usage of
the site for a 30 field soccer park, said assessment to include at the minimum
the Canadian Sports Tourism Alliance economic assessment model known as STEAM
(Sports Tourism Economic Assessment Model) to calculate the benefits to Ottawa,
there being no apparent need to calculate the obviously immense social and
health benefits to the City;
AND FURTHER
that the City conduct a review of other municipalities that have similar large
scale sports facilities to become acquainted with any topics that could prove
important to the City should it choose to operate or procure the creation of a
sports facility on the Bowesville lands, with particular attention paid to the
sports parks in Winnipeg and Calgary that operate sports fields as in close
proximity to airport operations;
AND FURTHER
that the City in conjunction with Transport Canada and other experts in the
field, undertake a review of hazards and risks associated with the proximity of
the Bowesville lands to the Ottawa Airport.

June 7th, 2006 Canada will be playing Scotland at Twin Elm Rugby
Park as part of the four city International Churchill Cup;

be granted a stadium endorsement for their extended licensing application to
AGCO (Alcohol and Gaming Commission of Ontario);
AND WHEREAS AGCO
guidelines require that: "A resolution of the Council of the
Municipality in which the stadium is located approving the issuance of a
stadium endorsement must be obtained prior to submitting an application for a
stadium endorsement.”;
