This is a City-initiated Official
Plan Amendment application for Kanata West, which is generally located north
and south of Highway 417 in the vicinity of the Palladium Drive interchange and
the Huntmar Drive overpass as shown in Document 1. Kanata West includes approximately 725 hectares of
land. Existing buildings and uses
within Kanata West include Scotiabank Place, several office buildings, two municipal
works yards, rural residential dwellings, a place of worship, and agricultural
uses.
In September 2000, former Regional Council
approved Regional Official Plan Amendment No. 9, which expanded the urban
area to include Kanata West. Amendment
No. 9 required that the area landowners prepare a Concept Plan to guide zoning,
subdivision and public expenditures in the area, and that this Concept Plan be
approved by City Council before development can proceed.
The Kanata West Concept Plan was completed in
September 2002, and City Council approved the general land use and development
principles of the Concept Plan in March 2003.
According to the Concept Plan, Kanata West is intended to be a
sustainable community in terms of the mix of uses and the form of development,
and will provide a full complement of opportunities for people to live, work,
play and learn. The Concept Plan
provides for the accommodation of approximately 25000 jobs, 5000 residential
units, and supporting retail all within a framework of natural corridors and
waterways. The mix of uses will include
office, housing, retail, institutional, entertainment and leisure
activities.
At the time of the approval of the Concept
Plan, City Council directed staff to revise the draft City of Ottawa Official
Plan to accommodate the development of the Kanata West area to reflect the
Concept Plan. The draft City of Ottawa
Official Plan was revised in March 2003, and the Official Plan was adopted
by City Council in May 2003.
In July
2004, City Council adopted Amendment No. 13 to the City Council Approved
Official Plan. This Amendment added the
following policy to Section 5.3 (Other Implementation Policies) to permit
Council to consider the use of private agreements between landowners to cost-share
infrastructure:
“4. Subject
to City Council approval, the City may consider the use of private agreements
among landowners to cost-share roads, piped services, and other infrastructure
identified in Community Design Plans or comprehensive servicing studies
approved by Council. Such agreements
are initiated by landowners within a defined area and provide for the fair
sharing of infrastructure costs among the benefiting parties, to complement or
replace the provisions of a Development Charges By-law. Where such agreements
are in place, the City will require evidence of paid-up membership in the
agreement as a condition of approval for plans of subdivision and condominium,
site plan or severance applications.”
The Kanata West Owners Group Inc. is currently
in the process of preparing agreements to share the costs of the major
infrastructure projects and associated studies and plans required for the
development of Kanata West.
The purpose of the subject Official Plan Amendment application is to amend the City Council Approved Official Plan by adding the following policy to Section 5.3 (Other Implementation Policies):
“5. Landowners within Area 1 (Kanata West) shown on Annex 5 Urban - Areas Subject to a Community Design or Policy Plan approved by Ottawa City Council - shall enter into private agreements to share the costs of the major infrastructure projects and associated studies and plans (including but not limited to Infrastructure Planning, Environmental Assessments and Restoration Plans) required for the development of Kanata West, and the costs shall be distributed fairly among the benefiting landowners. Each agreement shall contain a financial schedule describing the estimated costs of the major infrastructure projects, and associated studies and plans, as well as the proportionate share of the costs for each landowner. The City shall include a condition of approval for all plan of subdivision and condominium, site plan and severance applications in Kanata West requiring notification from the Trustee of the Kanata West Owners Group Inc. that the owner is party to the agreements and has paid its share of any costs pursuant to the agreements.”
DISCUSSION
The proposed Official Plan Amendment will add a policy to the City Council Approved Official Plan requiring the Kanata West landowners to enter into private agreements to share the costs of the major infrastructure projects and associated studies and plans required for the development of Kanata West. The agreements are intended to facilitate the implementation of the major infrastructure projects required for Kanata West. The Kanata West Owners Group Inc. is currently preparing private cost-sharing agreements that will describe the major infrastructure projects required for Kanata West, the estimated cost of each project, and each landowner’s proportionate share of the estimated cost of each project. Costs are to be distributed fairly among the benefiting landowners.
The cost-sharing agreements are intended to include the following Kanata West projects identified in the 2004 Development Charge Background Study:
In addition to these projects, the Kanata West
Concept Plan, the Carp River Watershed/Subwatershed Study, the draft Kanata
West Infrastructure Master Servicing Study, and the draft Carp River, Poole
Creek and Feedmill Creek Restoration Class Environmental Report have identified
the need for other major infrastructure projects to support the development of
Kanata West. These projects include,
but are not limited to, trunk storm sewers and stormwater management
facilities, and the restoration of the Carp River, Poole Creek and Feedmill
Creek. The cost-sharing agreements are
intended to include these projects in addition to the projects identified in
the 2004 Development Charge Background Study.
To ensure that all of the
landowners participate in the cost-sharing of the major infrastructure projects
required for Kanata West, the City will require evidence of paid-up membership
in the cost-sharing agreements as a condition of approval for all plans of
subdivision and condominium, site plan or severance applications in Kanata West.
In this regard, notification will be required from the Trustee of the
Kanata West Owners Group Inc. that the owner is party to the agreements and has
paid its share of any costs pursuant to the agreements.
ENVIRONMENTAL IMPLICATIONS
The proposed Official Plan Amendment will add a policy to the City Council Approved Official Plan requiring private cost-sharing agreements to facilitate the implementation of the major infrastructure projects required for Kanata West. The environmental implications of the major infrastructure projects are being considered through the following Environmental Assessments: the Kanata West Road Network Environmental Study Report; the Kanata West Infrastructure Master Servicing Study; and the Carp River, Poole Creek and Feedmill Creek Restoration Study.
CONSULTATION
Notice of this application
was carried out in accordance with the City’s Public Notification and
Consultation Policy. In addition,
notice of the public meeting was given to all landowners within Kanata West
based on the City’s latest Assessment Roll information. The Ward Councillors are aware of this
application and the staff recommendation.

FINANCIAL IMPLICATIONS
The City of Ottawa owns approximately 30 ha of land in Kanata West excluding lands that have been dedicated as public roads. The proposed Official Plan Amendment will add a policy that requires all Kanata West landowners to enter into private agreements to share the costs of major infrastructure projects including the costs of associated studies and plans. The City, as a landowner, would be required to pay its proportionate share of these costs, and funds would be requested as part of the Capital budget process, if the City chooses to develop its lands.
APPLICATION PROCESS TIMELINE STATUS
This
application, which was initiated by the City, was not processed by the "On
Time Decision Date" established for the processing of Official Plan
Amendment applications. The application was
processed concurrently with the Environmental Assessments for Kanata West: the
Kanata West Road Network Environmental Study Report; the Kanata West Infrastructure Master Servicing
Plan; and the Carp River, Poole Creek and Feedmill Creek Restoration Plan. Delays in completing these Environmental
Assessments affected the schedule for the subject Official Plan Amendment
application.

PART A - THE PREAMBLE
1. Purpose
The purpose of this Amendment is to amend the text of Section 5.3 (Other Implementation Policies), as amended by Official Plan Amendment No. 13, to add a policy that requires all landowners within Kanata West to enter into private agreements to share the costs of the major infrastructure projects, and associated studies and plans, required for the development of Kanata West.
2.
Location
The lands affected by this Amendment consist of approximately 725 hectares of land located north and south of Highway 417 in the vicinity of the Palladium Drive interchange and the Huntmar Drive overpass. These lands comprise the area known as Kanata West. The lands are legally described as Lot 1, part of Lot 2, Lot 3, and the south half of Lot 4, Concession 1, Geographic Township of Huntley, City of Ottawa (formerly in the Township of West Carleton); part of Lot 1, part of Lot 2, Lot 3, and part of Lot 4, Concession 1, Geographic Township of March, City of Ottawa (formerly in the City of Kanata); and parts of Lots 26 and 27, Lot 28 and part of Lot 29, Concession 12, City of Ottawa (formerly in the Township of Goulbourn). The lands affected by this Amendment are identified as Area 1 (Kanata West) on Annex 5 Urban -Areas Subject to a Community Design Plan or Policy Plan approved by Ottawa City Council - to the City of Ottawa Official Plan.

2. Details
The following changes are hereby made to the City of Ottawa Official Plan (2003):
1) Section 5.3, Other Implementation Policies, is amended to add the following policy 5 after policy 4:
“5. The implementation of this Amendment to the Official Plan shall be in accordance with the respective policies of the City of Ottawa Official Plan.

CONSULTATION DETAILS
COMMUNITY ORGANIZATION COMMENTS
Kanata Lakes Community Association
Comment: The Executive Committee of the Kanata Lakes Community Association is very concerned about the development in the Kanata West Area particularly having regard to the level of traffic on Highway 417 east of Eagleson Road and also having regard to the impact of the proposed development with respect to servicing, parks/recreation, drainage etc. as well as the transportation. The KLCA will be seeking answers to various issues in a community context.
Notwithstanding the studies that were undertaken some five years ago (approximately) in support of the Official Plan amendments that were introduced at the time, there have been several developments in the Kanata area in the interim and the resulting existing and proposed development warrants a review of the infrastructure based on current conditions. A major impact will result from the recently approved Official Plan Amendments (Del, Brookfield, and Westpark Estates). The KLCA is deeply concerned about the ability of the existing and proposed road system and other infrastructure to adequately accommodate the demands generated by/attracted to the TOTAL development in the Kanata/Stittsville area and, BEFORE THE PROPOSAL IS APPROVED, would appreciate receiving a copy of updated studies which have presumably been submitted in support of the proposal and, in particular, any study which addresses the impact of the TOTAL development in the above area - notably on the capacity of Highway 417 east of Eagleson Road. Further, the KLCA Executive would appreciate having an opportunity to review any studies following which a public meeting should be held to allow residents of the Kanata Lakes area, in particular, to raise questions and/or issues which might be of concern to the KLCA and its members.
We recognize that a public meeting (acknowledged as being poorly publicized at the time) was held in June of this year to learn about two subdivisions in the Kanata West area; however we believe that the proposed Official Plan Amendment should be presented and discussed in a much broader context.
Response:
The issues raised by the Kanata Lakes Community Association relate to two Environmental Assessments that are currently underway in Kanata West - the Kanata West Road Network Environmental Assessment and the Kanata West Infrastructure Master Servicing Plan. Once the Environmental Study Reports are completed, they will be made available for public review at several local libraries, and the Kanata Lakes Community Association may comment on the studies through the Class Environmental Assessment process.
At the time of the circulation of the
application, staff were intending to add a private cost-sharing agreement
policy to the City Council Approved Official Plan and to modify the road
schedule and protected right-of-way widths for the major road network in Kanata
West to implement the recommendations of the Kanata West Road Network
Environmental Study Report. Due to
delays in the completion of the Environmental Assessment process, staff are
proceeding independently with the proposed Official Plan Amendment to add the
private cost-sharing agreement policy only.
This policy addresses the cost sharing of the major infrastructure
projects that will be required for Kanata West, but does not deal with the
scope of the projects.
A separate staff report and proposed Official
Plan Amendment will be prepared to modify the road network in Kanata West once
the Environmental Assessment process for the Kanata West Road Network has been
completed. A response to the
transportation comments from the Kanata Lakes Community Association will be
provided in the forthcoming staff report.
ADVISORY COMMITTEE COMMENTS
Comment: The Ottawa Forests and Greenspace Advisory Committee had the following comments on the application:
Greater respect for protection of the existing
hedgerows would be effected by realignment of roads when the detailed planning
and construction of the roads is undertaken.
Re-routing the major collector road linking
Palladium Drive with Hazeldean Road should be considered as an option. The
proposal has the major collector road running through a woodlot north of Maple
Grove Road and west of Iber Road.
Blending this major collector requirement with the major arterial road
from Hazeldean Road to Palladium Drive is possible and would only require an
extension of the major arterial road proposed as part of the application. This extension would be north of Maple Grove
Road to Palladium Drive (as shown on a sketch attached to the Committee’s
comments). Alternatively, a more direct
route could be considered where the collector road intersects Maple Grove Road
to where it intersects Palladium Drive as shown on the attached sketch as
option “B”. Either option would protect
more of the existing woodlot and require less paving in the area.
1.
Ensure
that existing hedgerows are retained and protected during the final plotting
and construction of all roads.
2.
Ensure
that appropriate measures are applied during the construction of all roads
where they cross the creeks in the area.
3.
Consider
option “A” or “B” to link Hazeldean Road and Palladium Drive as described above
and detailed on the attached sketch.
Blending this major collector requirement with the major arterial road
from Hazeldean Road to Palladium Drive is possible and would require an
extension of the major arterial road proposed as part of the application. This extension would be north of Maple Grove
Road to Palladium Drive. Alternatively,
a more direct route could be considered were the collector road intersects
Maple Grove Road to where it intersects Palladium Drive.
4.
Ottawa
Forests and Greenspace Advisory Committee may provide further comments
following review of the Environmental Study Report expected to be released
September 19, 2005.
Response:
As indicated earlier, staff were initially intending to prepare a combined Official Plan Amendment to add the private cost-sharing agreement policy to the City Council approved Official Plan and to modify the major road network in Kanata West. Due to delays in the completion of the Kanata West Road Network Environmental Assessment process, staff are proceeding independently with the subject Official Plan Amendment to add the private cost-sharing agreement policy only. A separate Official Plan Amendment and staff report will be prepared later to modify the road network in Kanata West once the Environmental Assessment process has been completed.

Hume read a statement required under the Planning Act, wherein he advised that anyone who intends to appeal this proposed Official Plan Amendment to the Ontario Municipal Board (OMB), must either voice their objections at the public meeting, or submit their comments in writing prior to the amendment being adopted by City Council. Failure to do so could result in refusal/dismissal of the appeal by the OMB.
Chair Hume advised that Councillor
D. Holmes has requested that discussion on this item be held until she returns
from a medical appointment. Councillor
G. Hunter said he was not prepared to do so.

proposed Official Plan amendment is to add a new cost-sharing policy to Section
5.3 of Official Plan Amendment 13 (Other Implementation Policies) approved by
Council in 2004, relating to landowners entering into private agreements to
share the costs of major infrastructure projects and associated studies and
plans for the development of Area 1, Kanata West.
The Committee was provided with
correspondence dated March 27, 2006, from Alannah and Wayne Mackinnon, of Maple
Grove Drive, objecting to being forced into cost-sharing with the City. Responding to a question from Councillor
Cullen, John Moser, Director, Planning & Infrastructure Approvals,
clarified that owners of small parcels of land, such as Mr. Mackinnon, would
not have charges levied against them if no development takes place on their
property.
The Deputy City Manager, Planning
and Growth Management, Ned Lathrop, advised that the City Maintenance Yard is
currently within the Kanata West area and the City has no plans to move that
infrastructure in the near future. He
added it was important to ensure that this area is protected for the future as
relates to cost-sharing agreements.
The Committee then considered the
report recommendation:
That the Planning and Environment Committee recommend Council approve
and adopt an amendment to the City Council Approved Official Plan to add a
policy that requires all landowners within Kanata West to enter into private
agreements to share the costs of the major infrastructure projects and
associated studies and plans required for the development of Kanata West, as
detailed in Document 2.
