The Mayor, Bob Chiarelli, presided and led Council in prayer.

1.                  The City of Ottawa urgently request the Federal Government to reconsider the premature termination of the SCPI program;

 

2.                  The Mayor of Ottawa meet with the Federal Minister of Housing on an emergency basis to seek an extension of the SCPI program;

3.                  This motion be circulated to City of Ottawa area Members of Parliament, AMO, FCM, and AFMO; and

 

4.                  A special Task Force be established with City staff, City representatives, and all those groups affected and interested to develop and implement strategies to ensure continuing SPCI funding beyond March 2007.

1.         enter into discussions with the existing parties (Clear Channel Outdoor, Creative Outdoor Advertising, Rideau Street Youth Enterprises) to the contracts, touching on street furniture / advertising / litter-recycling with the objective of getting the City to an integrated program in 2010 at either minimum cost to the City or at maximum revenue to the City, and report back to the Transportation Committee.

1.                  That Council approve an amendment to the former Rideau Zoning By-law 2004-428 to change the zoning of 5537 First Line Road from Development Zone (D) to Village Residential Exception (RV-X) and Environmental Protection (EP) zones as shown in Document 1 and detailed in Document 2.

 

2.                  That the implementing by-law not be forwarded to Council until such time as the Director of Planning and Infrastructure Approvals is satisfied with the hydrogeology, slope stability and storm water management reports, and that any modifications to the zoning necessary to reflect these reports be reflected in the by-law to be enacted by Council.

2.         Direct staff to convene a local public meeting hosted jointly by the proponent and the City to present the project to the local and sport communities and identify and seek resolutions to any outstanding issues or concerns.

 

3.         Direct staff to report to Council on the outcome of the negotiations in January 2007.

2.                  Approve the sale of the property referred to in Recommendation 1 to Colonnade Development Incorporated, in exchange for two parcels of land, shown as Parcels A and D on the attached Annex “A”, together with $770.00, plus GST, subject to any easements that may be required, pursuant to an Agreement of Purchase and Sale that has been received.

6.         MARCH HOUSE PROPERTY

 

 

COMMITTEE RECOMMENDATIONS

 

That Council:

 

1.                  Declare a parcel of land shown hatched as Parcels A & B on Annex “A” attached, containing approximately 0.755 hectares, described as Part of Lot 11, Concession 4, geographic Township of March, now in the City of Ottawa, subject to final survey, as surplus to the City’s needs;

 

2.                  Approve the relocation of the heritage building known as March House to lands as outlined in Recommendation # 1 as shown on Annex “A” for an estimated cost of $250,000 plus GST;

 

3.                  Approve staff bringing forward a rezoning application consistent with the City’s planning objectives as outlined in the body of this report;

 

4.                  Approve the “Request for Offers to Purchase” process, as specifically set out in this report, for the sale of the surplus March House property shown as Parcels A & B on Annex “A” of this report;

 

5.                  Approve the “Mandatory Requirements”, “Evaluation Criteria & Weighting” and the City’s Evaluation Committee for evaluating submissions and the selection of the preferred offer for Best Value as outlined in Annex “B”; and

 

6.                  Authorize the City Manager to finalize and execute the Agreement of Purchase and Sale and supporting documentation as outlined in Annex “B”.

That Council approve the establishment of additional capital authority for the King Edward Avenue rehabilitation in the amount of $9.9 million to be funded as follows:

 

1.                  $2 million to be transferred from the City Wide Reserve Fund;

 

2.                  $1 million to be transferred from existing projects within the Sanitary Sewer Rehabilitation Program; and

 

3.                  $6.9 million to be transferred from existing projects within the Integrated Road, Water and Sewer Program.

PLANNING AND ENVIRONMENT COMMITTEE REPORT 53A

 

 

1.             ZONING - 20 CEDAROW COURT

That Council approve an amendment to the former Township of Goulbourn Zoning By-law to change the zoning of the portion of 20 Cedarow Court currently zoned "CH" (Highway Commercial) to "C-XX" (General Commercial, Exception XX), as shown in Document 1 and detailed in Document 3.

That Council approve an amendment to the former Township of Goulbourn Zoning By-law to change the zoning of 866 (formerly 865) and 898 Eagleson Road from MG (General Industrial Zone), CC-1 (Commercial Core Special Exception Zone) and CH-8 (Highway Commercial Special Exception Zone) to MBP-xx (Business Park Industrial Exception Zone); MBP-xy and MBP-xz as detailed in Documents 3 and 4, as amended by the following:

 

WHEREAS the rezoning application for the Shillington lands represents a unique opportunity to introduce a high standard of retail and urban design along a new Arterial Mainstreet;

 

AND WHEREAS the applicants have indicated a willingness to develop the property in accordance with the recently adopted Design Guidelines for Arterial Mainstreets;

 

AND WHEREAS an important component of the success of this form of development is the design of the road right-of-way, to ensure pedestrian comfort, retail viability as well as good driving conditions;

 

AND WHEREAS a unique opportunity exists through the Eagleson Road Environmental Assessment (EA) to implement roadway design standards that coincide with the form of development proposed for the Shillington lands; then

 

BE IT RESOLVED that Planning and Environment Committee convey to the EA Team its support for the adoption of roadway design standards that will support the more urban and pedestrian friendly type of development proposed for the Shillington lands,

 

AND BE IT RESOLVED that these design standards be applied to the entire Eagleson Road corridor that is subject to the EA to establish the City’s intent that future development along the Arterial Mainstreet portion of Eagleson follows a similar urban and pedestrian friendly form.

2.         That the implementing Zoning By-law amendment not proceed to City Council until such time as revised Site Plan Control approval has been obtained for the entire lands at 249 and 251 Northwestern Avenue.

WHEREAS there is no monitoring procedure in place to ensure the contractor responsible for streetlight maintenance is doing the required work;

 

AND WHEREAS there have been problems with street light repairs not being done, even though staff in the Community and Streetlighting Unit have been told by the contractor that the lights were working again;

 

AND WHEREAS there are a number of other city services where work is done by a private sector partner;

 

THEREFORE BE IT RESOLVED that the City Manager prepare a report on which other public private partnership agreement do not have a procedure in place for monitoring the work of the private sector partner.

WHEREAS there have been problems with street light repairs not being done, even though staff in the Community and Streetlighting Unit have been told by the contractor that the lights were working again;

 

AND WHEREAS this has been extremely frustrating for residents who have had to report the same outage repeatedly without work being done;

 

AND WHEREAS there is no monitoring procedure in place to ensure the contractor is doing the required work;

 

AND WHEREAS the lack of a monitoring process and the problems of lights still not working after staff in the Community and Streetlighting Unit have been told by the contractor that repairs have been done raises concerns about whether the city is getting value for money;

 

THEREFORE BE IT RESOLVED that the Deputy City Manager of Public Works and Services be instructed to put a monitoring process in place for streetlight maintenance to ensure the City of Ottawa is getting value for money.

MOTION NO. 64/8

WHEREAS the Royal Swans were a gift to the City of Ottawa by Queen Elizabeth II in 1967 as a centennial commemoration;

 

AND WHEREAS residents of the City of Ottawa have, for the past 40 years, shown pride and interest in the Royal Swans as part of Ottawa’s heritage;

 

AND WHEREAS the public has expressed great concern that the Royal Swans were not given their freedom this spring, as is the normal practice, to spend the spring, summer and fall on the river;

 

AND WHEREAS the housing for the Royal Swans at the Leitrim facility, judged to be of questionable suitability for winter confinement of five months duration, is fully unacceptable, by any humane standards, for eighteen months of forced captivity;

 

AND WHEREAS there are improvements that the City of Ottawa can and should make immediately to upgrade this facility to ensure a humane standard of care;

 

THEREFORE BE IT RESOLVED that a Task Force made up of representatives from the Ottawa Royal Swan Coalition to ensure that the public’s concerns are addressed, the avian veterinarian consultant, a City staff member and a City Councillor or their representative be formed to meet by August 30, 2006;

 

AND BE IT FURTHER RESOLVED that this Task Force’s recommendations for improvements, including those to the facility, be undertaken to ensure that the quality of life for the Royal Swans meets an acceptable standard for the fall and winter months and that these actions be implemented immediately upon approval of the Corporate Services and Economic Development Committee;

 

AND BE IT FURTHER RESOLVED that the Royal Swans be released onto the river in late April or early May 2007 or be transferred to another city so that they can be released with that city’s resident swans.

WHEREAS On March 8, 2006 Council approved by-law 2006-79 to set the instalment due dates and the interest and penalty rates applicable to the collection of property taxes for 2006;

 

AND WHEREAS, as stated in by-law 2006-79, a penalty for late payment of 1.25% per month is added the day following the due date and the first day of each month thereafter.  Payments on account are applied first toward the outstanding interest and penalty, then to the oldest outstanding taxes;

 

AND WHEREAS residents express frustration and dissatisfaction with the rigidity of the above penalty rates being applied when circumstances are out of their control such as late delivery by Canada Post;

 

BE IT RESOLVED that in 2007 the City adopt the same system as Revenue Canada whereby a cheque mailed by the resident and dated by Canada Post by the deadline constitutes an on time payment.

WHEREAS the Province of Ontario in response to AMO’s 2005 call for a solution to the 3 billion dollar Provincial Municipal fiscal gap has announced a “Provincial-Municipal Fiscal and Service Delivery Review”;

 

AND WHEREAS Ontario is the only province in Canada that requires property taxes to subsidize provincial health and social services programs, like welfare and employment services, disability benefits, drug benefits, social housing, child care, homes for the aged, public health and ambulance services;

 

AND WHEREAS eliminating this subsidy would significantly reduce Ottawa property taxes.  For the average homeowner, property taxes would be reduced by $666, a decrease of 26.1%, and for the average commercial property, taxes would fall by $2,024, a decrease of 13.7%;

 

AND WHEREAS this fiscal review is a critical first step in providing much needed property tax relief;

AND WHEREAS it has been a long standing principle that income redistribution programs be funded by income taxes and not property taxes;

 

THEREFORE BE IT RESOLVED that Ottawa City Council support the Provincial-Municipal Fiscal and Service Delivery Review and urge the Association of Municipalities of Ontario (AMO) to ensure that the primary focus of the review is a solution to the provincial municipal fiscal gap that will provide much needed property tax relief.

WHEREAS Kanata has already experienced five separate power outages in the month of September;

 

AND WHEREAS the six power outages that occurred in Kanata in May, 2006 and the five power outages that occurred in June, 2006 demonstrate that five power outages in Kanata within a month is not any isolated event;

 

AND WHEREAS the number of power outages in Kanata is below the standard of service people should be able to expect from Hydro Ottawa;

 

AND WHEREAS residents expect the City of Ottawa, as the sole shareholder in Hydro Ottawa, to take steps to help address problems with the reliability of the electricity supply;

 

THEREFORE BE IT RESOLVED That Council request the Board of Hydro Ottawa to waive half of the Hydro Ottawa portion of the delivery charge for residents who have experienced an average of more than one power outage a month in the preceding year.

Integrated Street Furniture Report

Members of Council will recall that at the August 23, 2006 meeting pertaining to the above item, a motion was carried providing, in part, that:  “the entire integrated RFP be issued at a time that a successful bidder could be awarded the contract in 2008, with services scheduled to take effect as existing agreements expire.”  Subsequently, at the same meeting, a motion was carried to reconsider the matter at the September 13, 2006 Council meeting.  As a result of changing circumstances during the last several weeks, staff are providing this information for  Council’s reconsideration for the matter next week.

 

Last week members of Council received a letter from Mr. Paul C. Seaman of Clear Channel Outdoor Company Canada outlining alternatives to the Integrated Street Furniture Framework. We have also been advised by Eucan that they would like to negotiate some additional aspects of their exit agreement with the City.

 

Staff met with Clear Channel Outdoor Co. and Creative Outdoor advertising to obtain a thorough understanding of their proposal.  Both firms have provided additional correspondence clarifying the details in the form of proposals which are included in this memo for your review and consideration.

 

You will recall that in an earlier memorandum, staff outlined the required course of action required to meet the intent of the Motion 1 of the August 23rd Transportation Committee Meeting.

 

That Council direct staff to:

1.      enter into discussions with the existing parties (Clear Channel Outdoor, Creative Outdoor Advertising, Rideau Street Youth Enterprises) to the contracts, touching on street furniture / advertising / litter-recycling with the objective of getting the City to an integrated program in 2010 at either minimum cost to the City or at maximum revenue to the City, and report back to the Transportation Committee.

 

Based on discussion at Transportation Committee and the wording of the revised recommendation, staff interpret this recommendation as follows:

 

1.      Complete the termination agreement with EUCAN for litter/recycling bins.

2.      Award the 2-year extension to Clear Channel (that already exists in the City’s contract with it) for transit shelters so that the contract is extended through to 30 June 2010.

3.      Negotiate a bus bench contract extension of approximately 2 years with Creative Outdoor Advertising so that contract termination date is synchronized with the transit shelter contract.

4.      Investigate the possibility of having Creative Outdoor Advertising manage advertising on the litter/recycling bins through to 30 June 2010.

5.      Investigate the possibility of continuing to engage Rideau Street Youth Enterprises for litter/recycling collection and bin maintenance services.

 

Although the termination agreement between Eucan and the City remains unresolved, and some risk continues to exist particularly around the issue of ownership of the litter/recying bins, the proposals from both Clear Channel and Creative Outdoor appear to mitigate the most serious consequences of the Eucan contract default and withdrawal of service.  Benefits of the proposal include continuity of service, the elimination of the debt to RYSE and reduced transition costs.  A further benefit of the approach recommended by the two service providers is that the three existing service contracts would extend until 30 June 2010, allowing the City to conduct thorough community consultations, and compete the integrated street furniture opportunity well in advance of the contract expiry.

 

While staff feel that the current proposals from Clear Channel and Creative Outdoor Advertising are largely sufficient to conclude satisfactory extensions to the existing agreements, nevertheless, there are some non-monetary items that will have to be revised somewhat from that which is currently contained in the proposals from these parties in order to fulfill necessary procurement and/or legal requirements.  In addition, Transit staff will require additional negotiations with the proponents specifically relating to the Transit shelters.
