The Council of the City of Ottawa met at Andrew S. Haydon Hall, 110 Laurier Avenue West, Ottawa, on 24 January 2007 at 10:00 a.m.

 

The Mayor, Larry O’Brien, presided and the Clerk led Council in prayer.

 

The National Anthem was performed by Berrigan Elementary School Choir.

 

 

MOMENT OF SILENCE – patricia hume

 

Council observed a Moment of Silence in memory of Councillor Peter Hume’s mother, Patricia Hume. 

 

MOMENT OF SILENCE – Lloyd Francis

 

A Moment of Silence was observed in memory of Lloyd Francis, a former Member of Parliament for Ottawa-West, former Speaker of the House, former Ambassador to Portugal and former Alderman, Deputy Mayor and Controller for the City of Ottawa.

 

 

Announcements/Ceremonial Activities

 

PRESENTATION – DR. DAN OFFORD EXCELLENCE AWARD

 

Mayor O’Brien presented the 2006 Dr. Dan Offord Excellence Award to Mr. Hussein Yusuf.  As well, the Mayor presented certificates to the three other 2006 nominees: Sgt. Dominic D’Arcy, Mr. David Millen and Mr. Jean-Yves Paul.  Mrs. Margaret Offord, the wife of the late Dr. Dan Offord, was also present and took part in the ceremony.


 

 

UNITED WAY / CENTRAIDE CHEQUE PRESENTATION

 

Mayor O’Brien and Richard Hewitt, 2006 United Way / Centraide Campaign Chair, unveiled the total amount of funds raised by City employees for the United Way, which was $539,232 and which exceeded the City’s goal by $39,232.  Michael Allen, President and Chief Executive Officer, United Way / Centraide of Ottawa was present to accept these funds on behalf of United Way.

3.             2007 interim property tax rates and due dates

That Council approve:

 

1.         That the 2007 interim property tax billing be set at 50% of the 2006 Adjusted Annualized Taxation as permitted by legislation;

2.         That the amount protected classes are billed on the interim tax billing be set at the maximum percent of last years' adjusted taxation, as permitted by legislation (50% of the adjusted 2006 taxes);

3.         That the following tax due dates be approved for 2007:

i.        Interim: March 15, 2007

ii.       Final:                 June 21, 2007; and

 

4.         That the penalty and interest percentage charge on overdue and unpaid tax arrears remain at the rate of 1.25% per month (15% per year) unchanged from 2006.

4.             2007 CITY OF OTTAWA MUNICIPAL ACCESSIBILITY PLAN

That Council approve the 2007 City of Ottawa Municipal Accessibility Plan (COMAP) for implementation, as required by the Province’s Accessibility for Ontarians with Disabilities Act, 2005 (AODA), subject to the 2007 budget process.

5.             RECORDS RETENTION AND DISPOSITION BY-LAW 2003-527, SCHEDULE A AMENDMENTS

That Council amend the Records Retention and Disposition By-law No. 2003-527 to incorporate the revisions to Schedule 'A ', as outlined in Document 1, subject to the approval of the City's external auditor.

6.             DISPOSAL AND SALE OF SURPLUS PROPERTY - 150 MONTREAL ROAD - 1436705 Ontario INC.

 

Committee Recommendations

 

That Council:

 

1.         Declare a parcel of land shown on Annex “A” attached, containing approximately 6956.0 m2, being part of Registered Plan 39 and shown as Parts 1,2,4,5 and 6, Plan 5R-4023 Vanier/Gloucester, in the City of Ottawa, as surplus to the City ’s needs;

 

2.         Approve the sale of the land described in Recommendation 1 to 1436705 Ontario Inc., for $850,000.00 plus GST, pursuant to an Agreement of Purchase and Sale that has been received; and

 

3.         Waive those internal procedures for the disposal of surplus properties, as set out in Schedule B of By-law 2002-38, that apply to the internal and external circulation of surplus properties, potential for housing, and publicly marketing the property for sale, in respect of the land sale set out in Recommendation 2.

7.             iNTENTION TO EXPAND THE BARRHAVEN BUSINESS IMPROVEMENT AREA BOUNDARy

That Council:

 

1.         Designate the area described by Document 1 as an expanded Business Improvement Area (BIA), under Sections 204 and 209 of the Ontario Municipal Act, 2001;

 

2.         Authorize and direct the City Clerk to send out a notice of Council's intention to pass a by-law to alter the existing BIA boundaries, as defined in Document 1, in accordance with Section 210 of the Ontario Municipal Act, 2001;

 

3.         Authorize and direct the City Solicitor to prepare a by-law to designate the area as an expanded Business Improvement Area, as described in Document 1, in accordance with Sections 204 and 209 of the Ontario Municipal Act, 2001; and

 

4.         Enact the aforementioned by-law in accordance with section 204 and 209 of the Ontario Municipal Act, 2001, subject to the City Clerk receiving favourable results on the notice of intention referred to in Recommendation 2.

8.             AMENDMENT TO DEVELOPMENT CHARGES BY-LAW 2004-307 MONAHAN DRAIN AND FRONT-ENDING AGREEMENT STORMWATER MANAGEMENT FACILITY AREA 2

 

Committee Recommendations

 

That Council:

 

1.         Approve the amending background study as identified in Document 3, being an amendment to Development Charges By-law 2004-307 to reflect changes in the rates of the benefiting area for the Monahan Drain Area (W-1);

 

2.         Authorize the City to enter into a Front-Ending Agreement with TCK Co-Tenancy and Claridge Homes (Eagleson) Inc. for the cost reimbursement for land acquisition, design, and construction of the Monahan Drain Stormwater Management Facility, Area 2 based upon the principles set out in Document 1, and City Council approved Front-Ending Policy noted in Document 2 with the final form and content of the Front-Ending Agreement being to the satisfaction of the Deputy City Manager, Planning, Transit and the Environment and the City Solicitor;

 

3.         Approve the expenditure of $6,361,125.00 for land acquisition, design and construction of the Monahan Drain Stormwater Management Facility Area 2, subject to the execution of the Front-Ending Agreement; and

 

4.         Authorize the City to establish a budget in the amount of $6,361,125.00 for the Monahan Drain Stormwater Management Facility Area 2 land acquisition, design, and construction, under Internal Order Number 903250: Stormwater Pond Monahan Drain.

WHEREAS the discussion of the Monahan Drain and the proposed Amendment to the City’s Development Charges By-law raised many questions at the Corporate Services and Economic Development Committee last Tuesday;

 

AND WHEREAS the staff response to these issues was only distributed to Members of Council earlier this morning;

 

AND WHEREAS the amendment to the Development Charges By-law will only be before Council at its next regular meeting on February 14th, when it would take effect;

 

THEREFORE BE IT RESOLVED that Council defer this item to its next regular meeting of February 14th; and

 

BE IT FURTHER RESOLVED that City staff meet with all parties prior to this item being considered by Council.

COMMUNITY AND PROTECTIVE SERVICES COMMITTEE REPORT 1

 

 

1.             REQUEST FOR FUNDING INCREASE TO THE COMMUNITY MUSEUM OPERATING   GRANT

 

 

Committee recommendationS

 

That Council approve the following:

 

1.                  That Council support the activities of the Ontario Museum Association task force aimed at obtaining a $10 million increase in funding for the Ontario Ministry of Culture’s Community Museum Operating Grant program;

 

2.                  That City Council send letters to Ontario Premier Dalton McGuinty and Ontario Culture Minister Caroline Di Cocco, requesting that additional credits be accorded to the program and that these funds be available starting with the next round of funding applications in June 2007; and

 

3.                  That Mayor Larry O’Brien personally follows up on this matter with the Premier of Ontario.

2.             IMPLICATIONS OF THE PROPOSED BILL 140 - LONG TERM CARE HOMES ACT

 

 

COMMITTEE RECOMMENDATION AS AMENDED

 

That Council advise the Minister of Health and Long Term Care of the City's position on Bill 140, the proposed Long-Term Care Homes Act, 2006 (the "Bill"), as follows:

 

a)         That any new standards imposed by the Bill must be accompanied by sufficient operating funds from the Province in order that municipalities may meet the new requirements without having to redirect funds already designated for other aspects of direct resident care;

b)         That Section 67 of the Bill dealing with Council be amended to reflect the provisions of the Public Hospitals Act regarding accountability;

c)         That the Province fulfill its 2004 commitment to provide increased funding for resident care by $6,000 per resident per year.

WHEREAS the City of Ottawa is already subsidizing the care and services provided to residents of the four City operated Long Term Care Homes and there is currently a well-established funding gap for Ontario Long Term Care Homes,

 

AND WHEREAS we are concerned about the financial implications of the new legislative requirements for compliance and reporting in the proposed Bill 140 that will increase the financial burden on Long Term Care Homes and may result in redirection of resources from resident direct care and services to administrative processes,

 

AND WHEREAS municipally operated Long Term Care Homes have a higher level of public accountability through municipal councils;

 

THEREFORE BE IT RESOLVED that if the Province fails to provide adequate additional funding to support the requirements of Bill 140, as recommended by the staff report  (ACS2007-CPS-LTC-0001), that the province recognize the existing public accountability of municipal Long Term Care Homes and exempt municipal Long Term Care Homes from the new accountability and reporting requirements of Bill 140.

3.                  That Document 3, Details of Recommended Zoning, be replaced with the following:

 

A residential (R5A) exception zone is established for the property at 1335 Prince of Wales Drive as shown on Document 1 with the following provisions:

 

In the case of an apartment building or retirement home,

 

1.   That the calculation of landscaped open space may include the area of a roof deck over parking spaces.

 

2.   For walls up to 13.5 metres in height, the side yard may be a minimum of 1.5 metres.

 

3.   The minimum rear yard setback for a roof deck over parking spaces shall be 1.5 metres.

 

4.   Parking shall be calculated at the rate of 0.4 spaces per dwelling unit and visitor parking shall be calculated at the rate of 0.13 parking spaces per unit after the first 12 units.

 

5.   Maximum building height is 13.5 metres.

1.         The Residential Apartment – High Density – Exception Two (R5B-X2) provisions of 6.21 are amended by adding a special building heigh provision that, notwithstanding the maximum building height for a main building in the R5B zone, permits a maximum building height of 105 metres at sea level, and no more than 10 storeys, for a single building located within the R5B-X2 zone and delineated as Block “F” on the accompanying zone key map.

That Council approve an amendment to the former Cumberland Urban Zoning By-law to change the zoning of 311 Centrum Boulevard and 3301 St. Joseph Boulevard from R5B-X3 to R5B-X3 (Block F), as shown on Document 1 and detailed in Document 3, by deleting Clause 1 and replacing it with the following:

TRANSIT COMMITTEE REPORT 1

 

 

1.             STATUS OF EAST-WEST LIGHT RAIL TRANSIT ENVIRONMENTAL ASSESSMENTS AND BUS RAPID TRANSIT PRIORITY PROJECTS

 

Committee Recommendation as amended

 

That Council direct staff to include in the 2007 Draft Capital Budget priority Bus Rapid Transit projects as identified in the Rapid Transit Expansion Study using the residual North-South Light Rail Transit funds as identified by the City Treasurer and available senior level government funding, and that the design of the West Transitway Extension section from the Southwest Transitway to Pinecrest Road be deferred until Council has determined the status of converting the Transitway to light rail transit.

1.         BE IT RESOLVED that Transit Committee Report 1 – Item 1 be referred to a joint meeting of the Transportation and Transit Standing Committees to be held in the summer of 2007, following the results of the Mayor’s Task Force and incorporating any other relevant information, so that City Council and the public can determine its transportation priorities from a City-wide perspective.

 

2.         AND THAT the Federal and Provincial government be requested to provide a formal commitment of unconditional block of funding of $200 million each to fund the transit system priorities to be confirmed by Council in the process described above.

That the Rules of Procedure be suspended to consider and approve the following Motion:

 

WHEREAS the Rural Issues Advisory Committee was created by City Council in the spring of 2006 as a result of recommendations arising out of the November 2005 Rural Summit;

 

AND WHEREAS in appointed members to the Rural Issues Advisory Committee, Council deviated from its standard practice of soliciting applications for membership, as set out in the City of Ottawa’s Appointment Policy, and appointed interim members for a six-month period;

 

AND WHEREAS no reserve members were appointed to the Rural Issues Advisory Committee in the spring of 2006 because the membership was deemed to be interim for a six-month period;

 

AND WHEREAS, as a result of resignations and the absence of reserve members, the membership of the Rural Issues Advisory Committee has significantly decreased, resulting in some rural wards being drastically under-represented;

 

THEREFORE BE IT RESOLVED that Council direct the City Clerk to recruit membership for the Rural Issues Advisory Committee in order to renew this Committee and allow it to continue to serve the rural residents and the City of Ottawa as effectively as possible.
