The Council of the City of Ottawa met at Andrew S. Haydon Hall, 110 Laurier Avenue West, Ottawa, on 25 April 2007 at 10:00 a.m.

 

The Mayor, Larry O’Brien, presided and the Clerk led Council in prayer.

 

The National Anthem was performed by St. Michael's Catholic School, Fitzroy Harbour Choir.

 

 

MOMENT OF SILENCE – national day of mourning

 

Mayor O’Brien announced that April 25th was the National Day of Mourning.  A Moment of Silence was observed to commemorate those workers who have been injured or who have lost their lives in the workplace.

RECOGNITION - ADMINISTRATIVE PROFESSIONALS WEEK

 

Mayor O’Brien proclaimed April 23rd to April 27th as Administrative Professionals Week in Ottawa. Ms. Sylvie Paul-Hus, President-Elect of the Ottawa Chapter of the International Association of Administrative Professionals, accepted the proclamation from Mayor O’Brien.

1.             Immigration Ottawa INitiative

 

 

COMMITTEE RECOMMENDATIONS AS AMENDED

 

That Council approve the following:

 

1.         Recognize the importance of immigration to the City’s economic prosperity by endorsing the establishment of an Immigration Ottawa Initiative (IOI) to facilitate the development of a community-led, citywide labour market integration strategy for immigrants, and that staff report back with a proposed governance structure and detailed Terms of Reference within six months.

 

2.         That the following three key elements be integrated into the Strategy:

 

a.         That the differences and inequalities between women and men in immigrant populations be integrated throughout the work of the initiative so as to address barriers experienced by women, such as family responsibilities, safety and literacy levels.

 

b.         That the initiative address the specific barriers of immigrants who face multiple barriers due to race, religion and language, including that of francophone immigrants.

 

3.         That the City’s Employment Equity program be an integral part of this initiative so that the City of Ottawa demonstrates leadership in this area.

2.             EMERGENCY MANAGEMENT PROGRAM – Year 3

 

 

That Council:

 

1.                  Receive this annual report on the Emergency Management Program- Year 3 for information.

 

2.                  Approve the enactment of a by-law as contained in document 1 that approves the Emergency Management Program including:

a.                  The Emergency Management Program - Schedule A.

b.                  The 2004 Emergency Management Plan, Version 1.0 - Schedule B (with the identified amendments).

c.                   The membership of the Emergency Management Program Committee to also serve as the Municipal Emergency Control Group - Schedule C.

d.                  The delegation of authority to the Manager, Office of Emergency Management as the primary Community Emergency Management Coordinator and the authority to delegate alternate(s).

e.                  The designation of the Community Emergency Information Officer.

f.                    An annual review by Council of the Emergency Management Program.

g.                  Delegation of authority to the Manager, Office of Emergency Management to make minor administrative amendments or to update functional responsibilities to the City of Ottawa’s Emergency Management Plan and its appendices provided the EMP Steering Committee has approved the changes and to the City Solicitor to place any required by-law amendments directly on the Agenda of Council.

 

3.         Approve the Municipal Evacuation Plan, Version 1.0 and that it becomes an Appendix to the City of Ottawa Emergency Management Plan.

That Council:

 

1.         Approve an amendment to the contract with OCIP on the operation of the Bell Sensplex allowing for an annual financial adjustment of $400,000 for the next three and a half years with a re-evaluation after January 1, 2011.

 

2.         Direct staff to report back to Council at the end of three and a half years with recommendations on the partnership agreement.

 

3.         Approve that the additional $245,000 provided to the operating reserve fund by the City be repaid prior to January 1, 2011 and that any additional revenues generated during this period be used to replenish the operating reserve fund.

 

4.         Delegate authority to the Deputy City Manager of Community and Protective Services to adjust the associated legal agreements to reflect these changes.

WHEREAS the P3 model has been used to provide a number of new City facilities;

 

AND WHEREAS, funds for these projects represent a significant commitment of tax dollars;

 

AND WHEREAS, the City has a responsibility to ensure taxpayers are getting value for money;

 

THEREFORE BE IT RESOLVED That an annual report be produced on City facilities provided through the P3 model that will include a comparison of performance to the results that were expected to be achieved under the P3 agreement for:

 

1.                  Revenues and expenses

2.                  The condition of the facility

3.                  Levels of service

 

BE IT FURTHER RESOLVED that the annual report shall also include an evaluation of the complaints from the public;

 

BE IT FURTHER RESOLVED that the evaluation include collecting feedback from stakeholders.

1.             2007 CAPITAL BUDGET - MOTIONS OF COUNCIL

That Council approve:

 

1.         The use of debt authority to refinance Growth and Renewal capital projects as identified in Appendix B in order to return $9.042 million to the City Wide Reserve Fund;

 

2.         The funding of the additional capital projects listed in Appendix C as approved by Council per the Capital Omnibus Motion - 8/6, which includes tax-supported debt authority of $7.262 million; and

 

3.         The transfer of $2.924 million from the City Wide Reserve Fund to the Water and Sewer Reserve Fund to address Motion 8/8.

3.         The adoption of the following tax ratios and by-laws for the mandatory property subclasses and the tax rate percentage reduction for farmland awaiting development:

·        Commercial excess land (i.e. commercial, office and shopping centre tax classes) - 70% of the applicable commercial property class tax ratio;

·        Vacant industrial land, industrial and large industrial excess land - 65% of the applicable industrial property class tax ratio;

·        Farm lands awaiting development subclass I - 70.0% of the residential property class tax ratio and the corresponding tax rate percentage reduction for the awaiting residential, commercial and industrial property classes; and Farm lands awaiting development subclass II - no tax rate reduction.

 

4.         That the tax rates for 2007 be established based on the ratios adopted herein.

 

5.         a)   That the 2007 capping parameters be approved at the higher of 10% of the previous year's annualized tax or 5% of the 2006 CVA; and

b)   That for 2007 capped/clawback properties whose recalculated annualized taxes fall within $250 of their CVA taxation be moved to their CVA tax for the year.

 

6.         That the tax level for "new construction" properties be set at a minimum level of 90% of their CVA taxes for 2007 and 100% for 2008 and future taxation years.

 

7.         That the property tax mitigation programs currently in place and detailed in this report be continued for 2007, including the Farm Grant program.

 

8.         That the final tax bill due date by-law be amended to reflect the decision to advance the date to June 14, 2007.

 

9.         That the Payment In Lieu of Taxation budget for 2007 be reduced, by the additional tax revenue generated from any assessment growth above the 2% already included in the 2007 budget, to reflect losses from the decreased clawback and that the final amount be reported to Council in the quarterly operating status report.

 

10.       That the tax relief (deferral) program for low-income seniors and disabled be amended to allow those eligible for the program to defer their property taxes and that staff submit an IPD by June of this year to CSEDC on the measures necessary to implement this program and further, that staff report annually on the impact of this program.

 

11.       WHEREAS in 2001, City Council enacted By-law No. 2001-276, which exempted branches of the Royal Canadian Legion within the City of Ottawa from taxation other than school taxes or local improvement rates for a period of ten years;

 

AND WHEREAS there is now a branch of the Royal Canadian Legion located in Barrhaven at 3023 Cedarview Road;

 

AND WHEREAS it is appropriate to provide the same exemption to this new branch;

 

THEREFORE BE IT RESOLVED that pursuant to Section 6.1 of the Assessment Act, R.S.O. 1990, c.A.31, as amended, Royal Canadian Legion Branch 641 located at 3023 Cedarview Road in the City of Ottawa be exempted from taxation, other than taxes or local improvement rates until 2011 as long as the premises are actually used and occupied by the branch of the Royal Canadian Legion.

4.             PUBLIC PRIVATE PARTNERSHIP - PETRIE ISLAND BEACH PAVILION

1.         That staff issue a request for proposals per the attached framework in Document 1, for the design, build, partial financing and privately operated beach pavilion at Petrie Island that will provide enhanced public spaces including washrooms and space for City life guarding operations;

 

2.         That the Request for Proposal reflects the City's potential capital contribution towards the construction of beach pavilion, previously approved capital budget, to a maximum of $900,000.00; and

 

3.         That the RFP process be expedited to have a report for decision before Committee and Council in September 2007.

2.         Direct staff to install the appropriate warning signage throughout the area;

 

3.         Refer the discharge channel and surrounding area to the Local Architectural Conservation Advisory Committee for review and heritage designation.

Motions Requiring Suspension of the Rules of Procedure

That the Rules of Procedure be suspended to consider the following motion:

 

WHEREAS the Madonna della Risurrezione Parish is hosting its 22nd Annual Community Festival on Friday, May 25 and Saturday, May 26, 2007 between the hours of 6:00 p.m. and 1:00 a.m. and on Sunday, May 27, 2007, between 8:30 a.m. and 11:00 p.m.;

 

AND WHEREAS exemption from subsections 18(1) and 19(2), (3) of the City of Ottawa Noise By-law (2004-253) is required to allow the use of sound reproduction devices which may surpass the allowed 55 decibel level, but will not exceed 65 decibels, in effect until 11:00 p.m. or which may disturb the peace and comfort of a resident after 11:00 p.m.;

 

THEREFORE BE IT RESOLVED that the provisions of subsection 18(1) and 19(2), (3) of the City of Ottawa Noise By-law (2004-253) shall not apply so as to preclude the use of sound reproduction devices during the Madonna della Risurrezione 22nd Annual Community Festival, which may exceed 55 dBA, but will not exceed 65 dBA, when measured at the property line of a business person or person whose peace and comfort is disturbed before 11 p.m. or disturbs the peace and comfort of a resident whose peace and comfort is disturbed after 11:00 p.m. on the dates of May 25, 26 and 27, 2007.

WHEREAS, on April 20, 2007, the City Manager announced the creation of a new City department called the Business Transformation Department;

 

AND WHEREAS this department will be comprised of many of the branches that were formerly part of the Corporate Services Department;

 

AND WHEREAS By-law No. 2005-503, the Delegation of Authority By-law, contained many provisions delegating certain authorities to the Chief Corporate Services Officer;

 

AND WHEREAS it is necessary to provide for these delegations on an interim basis pending finalization of the roles and responsibilities of senior staff within the new department at which time amendments will be drafted to the Delegation of Authority By-law;

 

THEREFORE BE IT RESOLVED THAT:

 

1.         The City Manager be delegated all authority currently delegated to the Chief Corporate Services Officer in By-law No. 2005-503.

 

2.         Despite Recommendation No. 1, the Executive Director of the Business Transformation Department be delegated the authority currently delegated to the Chief Corporate Services Officer with respect to real estate transactions.

WHEREAS, The City of Ottawa consists of identifiable and distinct communities;

 

AND WHEREAS, these communities should be identified on highway directional signs;

 

AND WHEREAS, the location of directional signs has been subject to political and bureaucratic finger-pointing;

 

AND WHEREAS, the community of Orléans is not identified on any highway signs on the 417 westbound approaching City Road 174;

 

BE IT THEREFORE RESOLVED that Ottawa City Council demand the Province install a directional sign for Orléans on the 417 (west bound) in addition to the existing Rockland sign;

 

AND BE IT FURTHER RESOLVED that this motion be sent to the MPP for Ottawa-Orléans and that he advise the City when such a sign will be installed.
