BACKGROUND
On
November 22, 2006, City Council passed By-law Number 2006-452 under Section 38
of the Planning Act.
By-law
Number 2006-452 has the effect of imposing Interim Control (I.C.) in the area
of the Rideau-Vanier Ward, excluding the By-Ward Market area, a six block area
of Sandy Hill to which a prior I.C. by-law applied on the same issue, and the
property known municipally as 433 Nelson Street (see Document 1).
The
purpose of I.C. By-law 2006-452 and its amending By-law 2006-471 is to prohibit
special needs housing including shelters, and group homes, as well as
retirement homes or homes for the aged, so that a study may be undertaken by
the City to review the existing zoning regulations for these uses in the area,
assess their effectiveness and modify or establish new regulations as required.
The proposed I.C. By-law will expire on November 22, 2007 or at such time as
the related study is complete and a report brought forward to City
Council. It is anticipated that a
Zoning By-law amendment will be brought forward implementing the findings of
the study by the end of this year.
DISCUSSION
The study is ongoing, and a document outlining the current and proposed zoning approach for the affected land uses, attached to a letter with a request for comments, has been sent to all interested stakeholders for their review and comment. As part of the study, a comprehensive review of the neighbourhood characteristics has been undertaken, and concerns voiced with respect to the amount of special needs housing, as well as with the over-concentration of social services within the Ward, have been considered within the context of this study. Meetings have been held with various stakeholders as well as with the Ward Councillor and the Housing Branch, with contact made also with Public Health Branch.
As the study findings and proposed approach were not completed until mid-summer, it was felt that inadequate time would be available for public input and preparation of the final report to meet the November deadline. As such, the reason for the extension is to ensure adequate time for public review and any consequent meetings that may arise in order to arrive at a recommended land use approach, particularly for those housing forms identified in the I.C. by‑law. It is anticipated that this work will be completed before the end of the year, with any related zoning regulations coming into force early in the new year. The I.C. period will be terminated at that time, before the one year extension would expire.
CONSULTATION
Public notification and consultation is not required for this report, although the document outlining the proposed zoning approach and letter sent to stakeholders informed them of this upcoming requested I.C. by-law extension. A public meeting of Planning and Environment Committee and City Council will also be held before any related by-laws are passed into law.
