That the Agriculture and Rural Affairs Committee recommend
Council:

BACKGROUND
The subject site is located on the south side of Fernbank Road, immediately west of Black's Side Road at the municipal address of 6620 Fernbank Road. The subject property is rural in nature with an existing single detached dwelling located on site, and is approximately 6.8 hectares in area, with 210 metres of frontage on Fernbank Road.
Surrounding uses include an active auto-wrecking operation and rural agricultural land to the north; rural land uses and a former waste disposal site are located to the northwest; an equestrian operation and rural residential development is located east of the subject property; estate residential and rural residential lots are located immediately to the south.
Purpose of Zoning Amendment
The purpose of this Zoning By-law
amendment proposal is to zone the subject property from Estate Residential (ER)
to Rural (RU). The intent of this
amendment is to permit the keeping of horses on the subject property, under the
Riding Horse Establishment use and subject to the provisions of Minimum
Distance Separation Guidelines (MDS).
The subject property was previously zoned RU prior to a Zoning By-law amendment approval in 2006 that amended the zoning to permit the Estate Residential use. This rezoning was part of a Plan of Subdivision application where the applicant had requested the 6.8-hectare parcel of land be zoned, along with the subdivision lands, to Estate Residential, thus removing the zoning right to keep horses on the subject lands. This was an oversight, as the applicant had intended on stabling two or three horses on this property.
Existing Zoning
Currently the subject site is zoned Estate Residential (ER), which does not permit the use of a Riding Horse Establishment. Permitted uses include: Group Home, Bed and Breakfast Establishment, Golf Course, Public Park and Single Detached Dwelling.
DISCUSSION
Official Plan
The Official Plan designates the lands as General Rural
Area. The intent of the General Rural Area designation is to accommodate a
variety of land uses that are appropriate for rural locations, including farms,
rural housing, woodlots, small industries and those non-agricultural uses that,
due to the nature of their operation or land requirements, would not be more
appropriately located within urban or village locations.
Details of Changes to the Goulbourn Zoning By-law
The Rural (RU) zone will permit such uses as a: Group Home, Bed and Breakfast Establishment, Conservation Use, Farms, Forestry Use, Rural Home Based Business, Kennel, Riding Horse Establishment and Single Detached Dwelling. The zoning provisions will adhere to the parent RU zone of Zoning By-law 40-99.
Details of Changes to the New Comprehensive Zoning By-law
It is intended that the draft new Comprehensive Zoning By-law will be passed by City Council on June 25, 2008.
The intent is to change the zoning of 6620 Fernbank Road from Rural Residential (RR2) to Rural Country Side (RU) to permit the keeping of horses on the subject property, subject to Minimum Distance Separation requirements.
Conclusions
The proposed Zoning By-law amendment is consistent with the General Rural Area policies of the Official Plan, where rural housing and those non-residential uses with specific rural land requirements are permitted uses.
The Minimum Distance Separation Guidelines (MDS), to minimize nuisance complaints due to odour, is applied at the time of building permit application to build a first or expanded livestock facility. The applicant has demonstrated that there is an adequate buffer distance on the subject parcel of land to locate a small horse barn such that it will not infringe upon the required MDS setbacks from adjacent rural residential lot lines.
There are no anticipated land use conflicts pertaining to this zoning application.
CONSULTATION
Notice of this application was carried out in accordance with the City's Public Notification and Consultation Policy. The Ward Councillor is aware of this application and the staff recommendation. The City did not receive any negative comments or opposition to this application.
FINANCIAL IMPLICATIONS
This application was processed by the "On Time Decision Date" established for the processing of Zoning By-law amendment applications.
