BACKGROUND
This application affects a portion of a lot located at 3545 St. Joseph Boulevard. The subject land is located north of St. Joseph Boulevard and south of Highway 174. The property at 3545 St. Joseph Boulevard is a vacant parcel while the property at 3535 St. Joseph Boulevard is a mobile home park. The purpose of the subject application is to amend the former City of Cumberland Zoning By-law to change the zoning of a part of 3545 St. Joseph Boulevard in fulfillment of a severance condition relating to a lot line adjustment. The applicants would like the intent of this zoning proposal reflected in the New Comprehensive Zoning By-law.
The owners of 3545 St. Joseph Boulevard would like to combine the subject parcel with the mobile home park abutting to the west. The part to be conveyed is land-locked, measuring approximately 116.75 metres by 3.05 metres and contains an area of 320.7 square metres. With this Zoning By-law amendment, the abutting landowner to the west will be able to consolidate the lands under one zone, that of the existing Commercial Highway – Exception 2, which permits a mobile home park. This consolidation will ensure that the mobile homes will no longer encroach onto 3545 St. Joseph Boulevard.
DISCUSSION
Official Plan
According to the Official Plan, the subject land is designated “General Urban Area”. This designation promotes the development of a full range and choice of housing types to meet the needs of all ages, incomes and life circumstances, in combination with conveniently located employment, service, cultural, leisure, entertainment and institutional uses.
Zoning
According to the Cumberland Zoning By-law 1-84, the site is presently zoned Commercial Highway – Exception 4 (CH-X4). This zoning permits the following uses: Mini Warehouse Storage and Public Storage, Warehouse, Outside Storage and Recreational Vehicle Sales and Storage in addition to all the uses of the Commercial Highway zone.
The applicant’s request to change the zoning of the site from Commercial Highway – Exception 4 (CH-X4) to Commercial Highway – Exception 2 (CH-X2) is considered appropriate as it will allow the subject lands to be combined with 3535 St. Joseph Boulevard, and to have the same zone.
The permitted main uses under the CH-X2 Zone are Mobile Home Park Laundromat, Mobile Home Park Management Office, Mobile Home Park Recreation Building, Mobile Home, Accessory Uses to the foregoing, Home Occupation and Private Park in addition to all the uses of the Commercial Highway zone.
It is anticipated that the New Comprehensive Zoning By-law will be adopted by City Council on June 25, 2008. The New Comprehensive Zoning By-law has 3545 St. Joseph Boulevard zoned General Mixed-Use Subzone 13 – Exception 215 (GM13[215]H(20)). The zone will permit the following uses: Warehouse, Automobile dealership limited to recreational vehicle sales and storage, Retail store limited to a home display court and Storage yard in addition to all the uses of General Mixed-Use Subzone 13.
In order to ensure that the intent of this Zoning By-law amendment is reflected in the New Comprehensive Zoning By-law and that all subject lands will continue to meet the zoning provisions, it is recommended that the subject lands known as part of 3545 St. Joseph Boulevard be rezoned from GM13[215]H(20) to Mobile Home Park Subzone 1 (RM1).
The permitted main uses under an RM1 Zone are community garden, group home, home-based business, home-based daycare, mobile home park, one dwelling unit for the use of the mobile home park manager and park.
All technical issues related to environmental, noise, traffic and servicing concerns do not apply in this rezoning application, as the land to be conveyed to the owner of 3535 St. Joseph Boulevard is already developed and no new development is planned on the subject land.
Staff recommends approval of this Zoning By-law amendment application.
CONSULTATION
Notice of this application was carried out in accordance with the City's Public Notification and Consultation Policy. The Ward Councillor is aware of this application and the staff recommendation. The City did not receive any negative comments or opposition to this application.
FINANCIAL IMPLICATIONS
This application was processed by the "On Time Decision Date" established for the processing of Zoning By-law amendment applications.
