BACKGROUND

 

Ray Neon Signs on behalf of St. James Anglican Church is requesting approval to install a non-illuminated identification ground sign with an illuminated programmable message centre that for the subject location exceeds the maximum sign face area limitations and is illuminated contrary to the by-law.

 

DISCUSSION

 

The property is zoned VM permitting the existing institutional use and classifying the property for sign regulation purposes under District 3.  In this District, an illuminated ground sign at the proposed scale and height is permitted.  A non-illuminated message centre as a component part of the sign is also permitted (see Document 2).

 

The intent of the unique sign regulations for District 3 is to recognize the mix of land uses that include residential, institutional and community level commercial.  The objective is to allow the identification and promotion of permitted land uses requiring signage while respecting other uses, in particular residential land use, by minimizing the potentially negative impact from large commercial signs with full illumination.

 

The By-law does accommodate land uses that need to display changing messages associated with the use of the property by permitting non-illuminated message centres to protect the area character.

 

With regard to the proposed sign, the main identification portion of the sign is non-illuminated carved wood.  The message centre would be illuminated only through the letters on an opaque background.  Ironically, in this case, the message centre may not be illuminated and the identification part of the sign may be illuminated.

 

Area land use includes commercial to the west adjacent to Manotick Main Street, a real estate office directly opposite on the north side of Bridge Street, single family residences on either side of the office and east of the church.  Further to the east is a second real estate office and a gas station (see Document 1).

 

The sign is to be mounted perpendicular to the street oriented toward passing motorists.  If approved, the information to be displayed on the message centre would be limited to static message, with streaming text/images and video are prohibited.  Messages would be limited to activities associated with the church.

 

As this principal vehicular link between the east and west sections of Manotick experiences a high volume of traffic on Bridge Street, the commercial nature of land uses fronting onto Bridge Street, the orientation of the sign away from the residential use directly opposite the site and the support from the community in response to the public consultation, the Department is satisfied that the proposed sign will have minimal negative impact on the community. 

 

In summary, the Department is satisfied that the proposed sign will not have a negative impact on the community as:

 

·           Bridge Street is the primary vehicular link between east and west Manotick,

·           Land uses fronting Bridge Street are primarily commercial,

·           The orientation of the sign will direct light away from the residential use directly opposite, and

·           The majority of responses to the required public consultation were in support of the application.

As these factors confirm that the proposed sign design will be consistent with the objectives of the Sign By-law, approval of the minor variance application is recommended.

 

CONSULTATION

 

Residents within 60 metres of the property, community and business groups and the Ward Councillor were circulated for comments.  In response to the technical circulation, seven respondents were in support of the application and one opposed.  The following was the expressed concern: "I have been trying to sell my mother's property at 1139 Bridge Street, (across the street from the Anglican Church) for almost two years now, I do not feel that a neon sign will enhance the chances for this sale.  The property may still be used as residential, even though it is designated as light commercial."

 

Departmental Comments

 

The building located on the property referenced by the concern owner is currently vacant, located between a real estate office and a retail commercial plaza, zoned V1P permitting a mix of land uses.  The proposed sign will be mounted perpendicular to the roadway thereby oriented toward the passing motorists.  As a primarily vehicular route and with the illumination from street lights and the adjacent commercial land uses, the illumination from the secondary message centre will not significantly increase the sign's impact on this area.

 

The Rideau Valley Conservation Authority indicated the application does not contain any matters that affect their mandate or interests.  The Ministry of Transportation have no concerns.  The Ward Councillor is aware of this issue.

 

LEGAL/RISK MANAGEMENT IMPLICATIONS:

 

Located on private property and having consulted with the community there are no anticipated legal issues that would implications for the City.

DISPOSITION

 

City Clerk and Legal Services Branch to notify the applicant, Ray Neon Signs Inc., 2870 Sheffield Road, Ottawa, K1B 3V9; the owner, St. James Anglican Church, Manotick, ON K4M 1A3 and Councillor Brooks of City Council's decision.  Building Code Services will process the sign permit resulting from the Council direction in accordance with Sign By-law 2005-439.
