That Planning and Environment Committee recommend Council approve a variance to Sign By-law 2005-439, to permit, on 100 Bayshore Drive, a ground sign with a height of 11 metres instead of eight metres.

The requested variance is to permit the installation of a new ground sign for the Bayshore Shopping Centre, which would exceed the height limit for a ground sign (see Document 1). In this case, the requested sign height is 11 metres whereas the by-law allows a sign with a height of eight metres. This application is a result of the relocation of the existing ground sign related to the expanded transitway located between Highway 417 and the building. A variance for the current sign was granted by Council in 2002 allowing a sign height of 10.7 metres.
The Department has reviewed the request and is of the opinion that the variance to allow a new sign height of 11 metres for the proposed signage would be acceptable. There would be little impact to adjacent residential uses as the sign location abuts Highway 417. The Ministry of Transportation has informed the Department that the proposed sign meets the Ministry’s criteria and guidelines.
While the increase requested from the By-law is significant, the applicant was required to relocate as the expanded transitway eliminated the current sign base. The new sign would be of similar scale to the current sign. Document 2 illustrates where the new sign will be relocated. In this case, the signage does not substantially impact on adjacent uses and is not out of character for this area.
In light of the above, the Department recommends approval of the requested variance.
In response to the standard circulation to property owners, business and community groups and the Ward Councillor, there were no objections received from the community feedback.
There are no legal/risk management implications associated with this report.

City Clerk and Legal Services Branch to notify the applicant, Montreal Neon Signs, Attention: Carlo Paolucci, on behalf of Ivanhoe Cambridge, 1780 Place Martenot, Laval, QC, H7L 5B5 and the local Ward Councillor of Council's decision. Building Code Services will process the sign permit resulting from the Council direction in accordance with Sign By-law 2005-439.
