That Planning and Environment Committee recommend Council approve a variance to Sign By-law 2005-439 to permit an internally illuminated logo sign, with an area of up to 15 per cent of the wall face, for the office building at 555 Legget Drive.

15 pour cent de la surface du mur de l’immeuble à bureaux situé au 555,
promenade Legget.
The subject property is located in an industrial business park zone and therefore classified as District 3 in the Sign By-law (see Document 1). Adjacent uses near this office building are commercial and leisure/recreational. The by-law permits logo signs in this zone provided the sign is non-illuminated and does not exceed 10 per cent of the top floor wall coverage area. The applicant requested variance that would permit the logo sign to be illuminated, with an area up to 24 square metres or 18 per cent of the wall face, is illustrated on the elevation plan shown on Document 2.
The requested variance would permit the illumination of a logo wall sign located on the top storey of this commercial office building for the tenant EMC2. Impact to nearby uses would be minimal as the illuminated logo sign would face towards mainly commercial uses and, on its own, would provide a limited negative impact to this area. However, increasing the percentage of wall area for signage from 10 per cent to 18 per cent represents a significant increase that, together with a growing number of logo signs in this area, will increase the total light impact in the night sky.
Therefore, the increase of the scale of the sign to 18 per cent of the wall face is not recommended as it would be disproportional to the scale of the building and would compound the overall impact of lighting in the neighbourhood encouraging ever increasing logo signs to the detriment of the adjacent residential community. Approval of a logo sign at 15 per cent of the wall area is preferred. Based on the wall area, an approval of 15 per cent would be 20 square metres of signage. This is consistent with other approvals granted by Committee and Council in this area.
Zoning of the property was light industrial under the former Kanata Zoning By-law, which represented a District 4 category in the Sign By-law. Logo signs under this district are allowed illumination. With the zoning changing in the new Zoning By-law to business park industrial, the more restrictive District 3 category now applies making the variance necessary. The new zoning of this property is under appeal.
Therefore, in this case, the Department is satisfied that the specified variance is in keeping with the intent and design regulations of the Sign By-law.
In response to the standard circulation to property owners, business and community groups and the Ward Councillor, there was no opposition generated.
There are no legal/risk management implications associated with this report.

City Clerk and Legal Services Branch to notify the applicant, Plastics of Ottawa, on behalf of the Kanata Research Park, Attention: Dennis Delaney, 32-5330 Canotek Road, Gloucester, ON, K1J 9C4 and the local Ward Councillor of Council's decision. Building Code Services will process the sign permit resulting from the Council direction in accordance with Sign By-law 2005-439
