modify the design approved by Council on April 9, 2008 for facade retention in
accordance with the design provided as Option C by John G. Cooke and Associates
Ltd. Engineers dated July 2009 attached as Document 4 and received on August
13, 2009; and
2. Require
the posting of financial security in the amount required to stabilize, brace,
relocate, store, reinstate and restore the existing brick facade in accordance
with Option C in the John Cooke report prior to the issuance of a building
permit for any demolition or construction activity on the site to the
satisfaction of the General Manager, Planning and Growth Management.

REPORT RECOMMENDATIONS
That the Local Architectural Conservation Advisory
Committee recommend that Planning and Environment Committee recommend that
Council :
1. Approve the
application by Fo Tenn Consultants Inc. to alter 453 Bank Street so as to
modify the design approved by Council on April 9, 2008 for facade retention in
accordance with the design provided as Option C by John G. Cooke and Associates
Ltd. Engineers dated July 2009 attached as Document 4 and received on August

2. Require the posting

Note : Approval to Alter this property under the
Ontario Heritage Act must not be interpreted as meeting the requirements for
the issuance of a building permit.
The 90-day timeline for approval of this application
under the Ontario Heritage Act expires on November 12, 2009.

BACKGROUND
At the City Council meeting of April 9, 2008 the approval for this development was granted subject to a portion of the façade of 453 Bank Street being retained in its original location (in situ). The text of that report together with background information is on file with the City Clerk and is available on the City’s website at:

This report deals with a revision to that initial application as it relates to the retention and preservation of the original building facade.
DISCUSSION
Recommendation 1.
An engineering study conducted by John G. Cooke and Associates dated July 2009 examined three options for the conservation of the existing building. Option A proposed complete dismantling and reconstruction of existing masonry. Option B proposed underpinning of the building in situ. Option C proposes sandwiching the facade between a steel frame, separating it from the foundation, lifting it to a temporary location in the excavated basement, lifting it back into place once the foundation wall is reconstructed, connecting the steel backup frame to the new structure and restoring the facade. This option is preferred by the consultant as it " conforms to the historic requirements of minimum intervention while minimizing the risk of damage to the wall." These options are described briefly in Document 3 as extracted from the John Cooke report and more fully in the complete report accessible electronically through the City Clerk and described as Document 4 .
Recommendation 2.
A financial security in the amount required for the work described in the John Cooke report to stabilize, brace, relocate, store, reinstate and restore the existing brick facade will be required as part of the Site Plan Control Agreement and will need to be in place prior to the issuance of a building permit for any demolition activity on the site. This security will revert to the City in the event that the façade retention is not completed for any reason. This security is required in accordance with the Official Plan policy described below:
2.5.5.21. In addition to requiring specific assessments as described above, the City will support its objective to conserve cultural heritage resources and to promote the stewardship of those resources by:
d. Entering into registered agreements with the owners of such designated properties if the City deems that financial securities are required from an owner to ensure the retention and conservation of heritage properties as part of a development approval. The amount of such financial securities will be determined by a qualified heritage architect, and be sufficient to ensure completion of the agreed-upon stabilization and conservation work based on the cost of the development and the costs associated with the conservation of the heritage resource;

There are no legal/risk management implications associated with this report.
FINANCIAL IMPLICATIONS
This application has been processed within the 90-day
timeline required under the Ontario
Heritage Act. That timeline expires on November 12, 2009.

The Local Architectural Conservation Advisory Committee (LACAC) is mandated to advise City Council on matters relating to Ottawa’s Heritage (pursuant to the Ontario Heritage Act), specifically on issues of built heritage, including cultural heritage landscapes. This includes providing City Council with advice on applications to alter designated heritage properties.
At its meeting on 3 September 2009, the LACAC considered the staff report concerning a revision to the application to alter 453 Bank Street, located in the Centretown heritage conservation district (ACS2009-ICS-PGM-0173), as it relates to the retention and preservation of the original building façade. This memo is to advise the Planning and Environment Committee that the LACAC approved on consent the following recommendations of staff:
