COMMITTEE RECOMMENDATIONS
That
City Council authorize the Mayor and City Treasurer to sign a Letter of
Agreement with the Province as part of the application to receive funding under
the Ontario Bus Replacement Program (OBRP) and approve the by-law authorizing
the signing of the Letter of Agreement as set out in Document 2.

That Transit Committee recommend City Council
authorize the Mayor and City Treasurer to sign a Letter of Agreement
with the Province as part of the application to receive funding under the
Ontario Bus Replacement Program (OBRP) and approve the by-law authorizing the
signing of the Letter of Agreement as set out in Document 2.

signer une lettre d’entente avec la Province dans le cadre de la demande afin
de recevoir un financement en vertu du Programme ontarien de remplacement des
autobus (PORA) et d’adopter un règlement autorisant la signature de la lettre
d’entente, comme il est exposé dans le Document 2.
The Province of Ontario provides
funding to municipalities under the Ontario Bus Replacement Program (OBRP) to
assist in the replacement of ageing transit buses. This is in recognition that ageing buses
contribute to higher operating costs, increased emissions, reductions in
service and reliability, and delays in achieving system accessibility.
In 2009, the Province identified that
the City will receive a maximum of $17,957,358 towards the replacement of
conventional and specialized transit buses.
Among the terms and conditions related to receiving this funding, the
City is required to provide copies of a signed Letter of Agreement and a by-law
authorizing the entering into such an agreement. Copies of both documents are attached to this
report.
The purpose of this report is administrative in nature and therefore no public consultation has been undertaken.
There are no rural impediments to the implementation of this Report’s recommendations.
There are no legal/risk management impediments to the implementation of this Report's recommendations.
Upon submission of copies of the signed Letter of Agreement, the authorizing by-law and the binding agreement between the City and a manufacturer of transit buses for the purchase of replacement transit buses delivered in 2009, the Ministry of Transportation will provide OBRP funding to the City, to a maximun amount of $17,957,358. This funding is to be provided to the City over a 12 year period from 2009 to 2021, equal to one-twelfth of the approved amount. OBRP funding was budgeted in the 2009 Capital Budget.

A by-law
of the City of Ottawa to authorize the entering into of an agreement with the
Province of Ontario relating to funding provided by the Province of Ontario to
the City under the Ontario Bus Replacement Program.
WHEREAS
the Province has provided for funding to support the replacement of aging municipal transit
buses;
AND
WHEREAS the Province has specified that as a condition precedent for
participating in this program, the City must enter into a Letter of Agreement
entitled: “Letter of Agreement between Her Majesty the Queen in right of the
Province of Ontario represented by the Minister of Transportation for the
Province of Ontario and the City of Ottawa Related to Funding Provided to the
Municipality under the Ontario Bus Replacement Program”, said Agreement to
pertain to the replacement of aging municipal transit buses;
The
Council of the City of Ottawa therefore enacts as follows:
1. The Mayor
and the Treasurer are hereby authorized to execute the Letter of Agreement
dated June 19, 2009 related to the Ontario Bus Replacement Program with the
Province of Ontario through the Minister of Transportation for the replacement
of aging municipal transit buses.
