REPORT RECOMMENDATION

 

That the  recommend Council approve an amendment to the former City of Cumberland Urban Zoning By-law to change the zoning of  Part of 2299 Tenth Line Road and Part of 2413 Tenth Line Road from D-R Development Residential to R1H-X3 and R3D-X13 as shown in Document 1.

Que le Comité de l’urbanisme et de l’environnement recommande au Conseil d’approuver une modification au Règlement de zonage urbain de l’ancienne Ville de Cumberland afin de changer la désignation de zonage d’une partie du 2299 et du 2413, chemin Tenth Line de D-R, aménagement résidentiel, à R1H-X3 et R3D-X13, comme il est indiqué dans le document 1.

 

 

BACKGROUND

 

The subject property is part of an old vacant farm field which now forms part of a new subdivision.  The subdivision in its entirety is bounded to the north by the future Blackburn Bypass, to the west by Tenth Line Road, to the east and south by future urban development land. 

 

Existing Zoning

 

The current zoning on these lands is D-R Development Residential which represents the former City of Cumberland Council's approval in principle of future residential development of the lands.

 

Proposed Zoning

 

The applicant has requested a Zoning By-law amendment to rezone these lands to an R1H-X3 zone and an R3D-X13 zone which will allow the development of residential single detached dwellings and row dwellings.

 

DISCUSSION

 

Official Plan

 

The Official Plan designates the subject property as "General Urban Area" which permits a full range of types and densities of housing to meet the needs of all ages, incomes and life circumstances, including low, medium and high density housing and seniors' apartments, in combination with well located employment, shopping, service, cultural, leisure, park, natural areas and institutional uses to facilitate the development of complete and sustainable communities.

 

Appeal to Draft Plan of Subdivision Approval

 

This area of the Draft Plan of Subdivision surrounding the property at 2385 Tenth Line Road has been appealed to the Ontario Municipal Board (OMB) by this property owner.  Staff supports the proposed Zoning By-law amendment as it relates to the Draft Plan of Subdivision currently in front of the OMB.  In the event that this zoning amendment is also appealed, it would be recommended that it be dealt with at the same time as the Draft Plan of Subdivision appeal before the Board.  The applicant is aware that if the OMB decision includes modifications to the Draft Plan of Subdivision, a further Zoning By-law amendment may be required to reflect these changes.

 

Details of Proposed Zoning

 

The proposal is to amend the zoning from D-R Development Residential to R1H-X3 to permit single detached dwellings.  The applicant has also requested a zone for row dwellings which requires a minimum front yard setback of 3.0 metres for a Main Building and 4.0 metres for a Private Garage.  Since this development is in an area of marine sensitive clay soils and given the Council policies requiring that tree planting in these soils be setback from main buildings by 7.5 metres and be located at a minimum of 2.5 metres from the curb, staff recommends that the front yard setback requirement be increased to 5.5 metres.  This distance, in addition to the width of the standard right of way in this area would permit the planting of the recommended species identified in the "Trees and Foundations Strategy in Areas of Marine Sensitive Marine Clay in the City of Ottawa" report presented to Planning and Environment Committee in September 2005. 


Therefore, staff recommends that the R3D-X13 zone which was used in Stage 10B of Avalon South and which includes the increase in the front yard setback be used in this location.  All other provisions of the R3D-X5 row dwelling zone would apply to the subject lands.

 

Traffic Issues

 

Transportation reports have been completed for the Avalon South - Neighbourhood 4 Subdivision.  Additional reports are not required for the zoning of Stages 9 and 10B, however Transportation Impact Studies may be required at the site plan approval or subdivision registration stages. 

 

CONSULTATION

 

Notice of this application was carried out in accordance with the City's Public Notification and Consultation Policy. The Ward Councillor is aware of this application and the staff recommendation.  The City did not receive any negative comments or opposition to this application.

 

FINANCIAL IMPLICATIONS

APPLICATION PROCESS TIMELINE STATUS

 

The application was not processed by the "On Time Decision Date" established for the processing of Zoning By-law amendments due to discussions regarding the modification to the housing mix shown on the approved Concept Plan for this developing neighbourhood.  The draft approval of the lands surrounding the property at 2385 Tenth Line Road was also appealed to the Ontario Municipal Board.
