REPORT
RECOMMENDATION
That the Agriculture
and Rural Affairs Committee and the Planning and Environment Committee receive
public delegations to allow for additional public consultation and possible
amendment to the Environmental Impact Statement Guidelines, regarding phased subdivision development, as
directed by Council at its meeting of 14 July 2010.
Que le Comité de l'agriculture et des affaires rurales et le Comité de
l’urbanisme et de l’environnement reçoivent les délégations du public en vue de
permettre la tenue d’autres consultations publiques et modifications possibles
aux Lignes directrices de l'étude d'impact sur l'environnement, au sujet de l’aménagement d’un lotissement par phases,
comme l’a exigé le Conseil au cours de sa réunion du 14 juillet 2010.
At
its meetings of 8 June 2010 and 8 July 2010, respectively, the Planning and
Environment Committee (PEC) and the the Agriculture and Rural Affairs Committee
(ARAC) considered a report pertaining to Environmental
Impact Statement Guidelines (ACS2010-ICS-PGM-0104, held on file with the
City Clerk). Both Committees “Carried”
the recommendations without amendment, and the report was then forwarded for
Council’s consideration (ARAC Report 55, Item 3) for its meeting of 14 July
2010, at which it was approved. In
addition, Motion 94/6, recommending an amendment to Recommendation 2 of the original report recommendations, was
referred to both the Agriculture and Rural Affairs Committee and Planning and
Environment Committee as outlined in Motion 94/7, below, to allow for
additional public consultation and possible amendment to the Guidelines (original
recommendations included for point of reference):

3. ENVIRONMENTAL
IMPACT STATEMENT GUIDELINES LIGNES

COMMITTEE RECOMMENDATIONS
That Council :
1. Approve
the Environmental Impact Statement Guidelines as detailed in Document 1,
including the Environmental Impact Statement Form and the Environmental Impact
Statement Decision Tool contained in the document as Appendices 1 and 2, for
use in the development review process, effective immediately.
2. Direct
staff to provide a transition period during which applicants will not be
required to adhere strictly to the new Environmental Impact Statement
Guidelines in the preparation of an Environmental Impact Statement for a
specific development or site alteration application if, prior to the approval
and adoption of these Environmental Impact Statement Guidelines by City
Council, the applicant has: (a) received
formal direction from City planning staff on the preparation and requirements
of an Environmental Impact Statement for that specific development or site
alteration application (i.e. during a pre-application consultation or
other consultation with City staff on the specific content of that
Environmental Impact Statement); and, (b), commenced preparation of the
Environmental Impact Statement in accordance with the direction from City
staff.
3. Direct
staff to undertake a review of the Environmental Impact Statement Guidelines’
content and process, beginning one full year after implementation, and
considering any written feedback received from local stakeholder organizations
or members of the public in that time, and to report back to Committees and
Council on the results of the review.

THEREFORE BE IT RESOLVED that
recommendation 2 be amended by the addition of the following:
“but where a
subdivision is proceeding in phases, the environmental impact statement will be
required to be completed or updated in accordance with the guidelines attached
to this report for all subsequent phases.”

That Motion No. 94/6 be referred to Planning and Environment Committee
and Agriculture and Rural Affairs Committee, for additional public consultation
and possible amendment to the Guidelines.
