REPORT RECOMMENDATIONS
That the Transportation Committee
recommend Council approve the following:
1. a waiver of Section 3(2) of the City of Ottawa Encroachment By-Law 2003-446 to permit the construction of a permanent surface encroachment at 25 Leacock Drive; and,
2. that the Acting Deputy City Manager, Public Works and Services Department, be given authority to enter into a legal agreement with the applicant.

afin de permettre un empiétement en surface permanent au 25, promenade Leacock;
et
2. que le directeur municipal adjoint
intérimaire, Services et Travaux publics, se voie accorder le pouvoir de
conclure une entente juridique avec le demandeur.
BACKGROUND
The City of Ottawa has received a request from the Ottawa-Carleton District School Board (OCDSB) to permit the placement of a cedar rail fence on the City’s right-of-way on the Leacock Drive frontage at the location of Stephen Leacock Public School. The City’s Encroachment By-law prohibits permanent surface encroachments, and, therefore, a waiver to the By-law is required for the fence to be permitted on the City’s right-of-way.
DISCUSSION
The OCDSB has contacted the City of Ottawa for
permission to construct a cedar rail fence that would encroach onto the road
allowance. The proposed fence is being
requested as the result of the Adult School Crossing Guard Program. The erection of the fence will guide
students to the delineated crosswalk and prevent jaywalking. In order to ensure that adequate sightlines
are maintained for drivers egressing the "u-" shaped driveway in
front of the school, the City has recommended that two existing parking spaces
be removed from the School's off-street parking lot and the fence be situated
partially on privately-owned (School) property and partially on City-owned
property. A plan showing the proposed
location of the fence can be found in Annex 1.
If the recommendations of this report are
approved by Council, the applicant must enter into a maintenance and liability
agreement with the City, to be signed by the Acting Deputy City Manager, Public
Works and Services Department, with conditions relating to the fence remaining
on City property, including costs, maintenance, liability, insurance and
indemnification.
It is the opinion of this Department that the safety of school children can be enhanced and traffic flows can be maintained with the placement of the cedar rail fence in this location, in accordance with the conditions.
CONSULTATION
No public consultation on this matter has taken place. Ward Councillor Peggy Feltmate is aware of and is in support of this report.

All costs paid for by proponent.

The Department will advise the applicant of Council’s
decision.
