2.         WAIVER TO THE ENCROACHMENT BY-LAW 2003-446 FOR STEPHEN LEACOCK PUBLIC SCHOOL

EXEMPTION DE L’APPLICATION DU RÈGLEMENT 446-2003 SUR L’EMPIÉTEMENT EN FAVEUR DE L’ÉCOLE PUBLIQUE STEPHEN-LEACOCK

That the Transportation Committee recommend Council approve the following:

 

1.         A waiver of Section 3(2) of the City of Ottawa Encroachment By-Law 2003-446 to permit the construction of a permanent surface encroachment at 25 Leacock Drive; and,

 

2.         That the Acting Deputy City Manager, Public Works and Services Department, be given authority to enter into a legal agreement with the applicant.

 

 

Que le Comité des transports recommande au Conseil d’approuver :

 

1.         Une exemption de l’application du paragraphe 3(2) du Règlement 446-2003 de la Ville d’Ottawa sur l’empiétement afin de permettre un empiétement en surface permanent au 25, promenade Leacock; et

 

2.                  Que le directeur municipal adjoint intérimaire, Services et Travaux publics, se voie accorder le pouvoir de conclure une entente juridique avec le demandeur.

 

 

3.         WAIVER TO THE PRIVATE APPROACH BY-LAW 2003-447 FOR 415-421 RICHMOND ROAD

That the Transportation Committee recommend Council approve a waiver of Section 25 (l) (i) of the City of Ottawa Private Approach By-Law 2003-447 to permit the construction of a private approach which is located less than 18.0 metres from the nearest intersecting street line.

 

 

Que le Comité des transports recommande au Conseil d’approuver une dérogation à l’article 25 (1) (i) du Règlement 2003-447 sur les voies d’accès privées de la Ville d’Ottawa en vue de permettre la construction d’une voie d’accès privée située à moins de 18,0 mètres du plus proche tracé de rue transversal.

5.         NEWSPAPER BOX PROLIFERATION

Prolifération des distributeurs automatiques de journaux

 

Whereas the City’s current sidewalk encroachment by-law regulates the placement of newspaper boxes so that they do not interfere with sightline or pedestrian mobility;

 

Whereas the City’s current sidewalk encroachment by-law does not regulate the quantity of boxes;

 

Whereas this results in certain corner locations storing a total of nine newspaper boxes;

 

Whereas this density of boxes is sometimes duplicated at consecutive blocks, as is the case for Bank and Third, and Bank and Second;

 

Whereas this is excessive, unnecessary, and ugly;

 

Be it resolved that City staff report back on limiting the number of newspaper boxes at any one location, balancing the City’s right to rent out its right-of-way with the right of the community to maintain an uncluttered streetscape aesthetic.

 

 

Attendu que le règlement actuel de la Ville sur l’empiètement des trottoirs régit l’aménagement de distributeurs automatiques de journaux afin d’empêcher toute interférence avec les lignes de visibilité ou la mobilité des piétons;

 

Attendu que le règlement actuel de la Ville sur l’empiètement des trottoirs ne régit pas le nombre de ces distributeurs;

 

Attendu que certaines intersections totalisent jusqu’à neuf distributeurs automatiques de journaux;

 

Attendu que cette densité de distributeurs se répète parfois à plusieurs intersections consécutives, comme par exemple à l’angle de Bank et Third et de Bank et Second;

 

Attendu que cette pratique est excessive, inutile et peu esthétique;

 

Il est résolu que le personnel de la Ville soit chargé de faire un rapport sur la possibilité de limiter le nombre de distributeurs automatiques de journaux par emplacement, permettant ainsi un équilibre entre le droit pour la Ville de louer ses emprises et celui de la collectivité de bénéficier d’une esthétique urbaine aérée.
