SUBJECT: WAIVER
TO THE PRIVATE APPROACH BY-LAW 170-73 AND THE REGIONAL REGULATORY CODE - 260 BESSERER STREET, 950 BANK STREET

1. That
the Transportation and Transit Committee recommend Council approve the waiver
of Section 13 (f) of the Private Approach By-Law 170-73 of the former City of
Ottawa to permit a third two-way access at 260 Besserer Street, to be located
less than twenty feet from another access servicing the same property.
2. That the Transportation and Transit Committee recommend
Council approve the waiver of subsection 2.6.18(8) of the Regional Regulatory
Code to permit an access at 950 Bank Street, to be located less than three
metres from an adjacent property line.

Conseil d’approuver une dérogation à l’article 13 (f) du Règlement municipal
170-73 de l’ancienne Ville d’Ottawa sur les voies d’accès privées afin de
permettre l’aménagement d’une troisième voie d’accès à 260 rue, Besserer, à
deux sens à moins de vingt pieds d’un autre accès desservant la même propriété.

Comité des transports et des services de transport en commun recommande au
Conseil d’approuver une dérogation au paragraphe 2.6.18(8) du Code de réglementation
régional afin de permettre l’aménagement d’une voie d’accès à 950 rue, Bank, à
moins de trois mètres de la limite d’une propriété adjacente.
Section 13 (f) of the former City of Ottawa Private Approach By-Law 170-73 provides that the distance between the nearest limits of a private approach intended for two-way vehicular traffic and any other private approach to the same property shall be a minimum of thirty feet.
Plans submitted for Site Plan Control for 260 Besserer Street include the construction of a six-storey apartment building and two levels of underground parking for sixty vehicles.
Proposed is construction of a third two-way access (non-complying), which would be located adjacent to the two-way access servicing the lower level of the underground garage. This third two-way access is required to service a single vehicle loading area.
Staff have reviewed the submitted plans and inspected this location and noted that:
The plans submitted for Site Plan Control for the Glebe Centre at 950 Bank Street pertains to a proposal to construct a six-storey replacement facility on the remaining vacant land at the south end of the site. The tower will be converted to Lifelease apartments with two levels of underground parking with access to Bank Street serving 91 parking spaces. This proposed access off Bank Street would be located approximately three feet from the southerly property line.
Staff have reviewed the submitted plans and inspected this location and noted that:
The Development Services Department is supportive of the proposed waivers for the locations identified above. The plan for 260 Besserer Street received tentative site plan control approval at Planning Committee on 25 April 2002, subject to the approval of the private approach waiver. At the time of submission of this report, the site development plan for 950 Bank Street was to be considered through delegated authority.
It is the opinion of this Department that the construction of the third two-way private approach at 260 Besserer Street and a two-way access at 950 Bank Street at the Glebe Centre will not create any foreseeable vehicular or pedestrian safety hazards.
No environmental impact is anticipated and the recommendation is within the Municipal Environmental Evaluation Process (M.E.E.P.) Automatic Exclusion List – Section I (f) Routine Operations.
No public consultation on the recommendations has taken place. The Department believes the proposed private approaches at 260 Besserer Street and 950 Bank Street will not adversely affect established traffic patterns in the immediate area.
Ward Councillor Madeleine Meilleur and Ward Councillor Clive Doucet are aware of and concur with the recommendations of this report.
